CHAPTER 255. •

AN ACT to authorize the payment to the Mary-
land and Delaware Railroad Company, and to
the Dorchester and Delaware Railroad Compa-
ny, of the sum of thirteen thousand dollars, ap-
plied to the Choptank and Mispillion Railroad
Company by the Act of eighteen hundred and
sixty, chapter three hundred and three, accord-
ing to the provisions of section three of said
Act.

22,1867.

WHEREAS, by the third section of the Act of
eighteen hundred and sixty, chapter three hun-
dred and three it is declared, that if any portion
of the fund thereby applied to the projected rail-
road, on the Eastern Shore therein enumerated,
should not be demanded according to the provi-
sions of the said Act, by any of the said compa-
nies, the faith of the State was thereby pledged to
apply such portion to works of internal improve-
ment in the county to which the same may properly
belong; and whereas, the sum of thirteen thousand
dollars by said Act applied to the Choptank and
Mispillion Railroad Company, as part of the fund
assigned to Caroline County has not been demanded
by said company since the passage of the said Act,
and no evidence has been produced by said com-
pany of their ability or intention to demand the
same according to said Act, during the coming
year, although apprized of an application pending
before the General Assembly to divest the said
sum in accordance with the power reserved by the
third section of the said Act; and whereas, the
Maryland and Delaware Railroad Company has
completed twenty-four miles of its road, the greater
part through Caroline County, and the Dorchester
and Delaware Railroad Company propose to build
a railroad from the Delaware Railroad in the State
of Delaware, to Cambridge in Dorchester County,
and to carry the same through a part of Caroline
County as hereinafter described, and it is proper
that the said fund which has remained idle in the
treasury for seven years should be made conducive
