38. No person resident in the city of Baltimore
and having a license to sell therein, shall suffer or
permit any person not being a permanent resident
of said city and not in his regular service or em-
ploy, or in the regular service or employ of his
firm or copartnership, to sell any goods, wares or
merchandise in any of the modes mentioned in
the preceding section, under his name or the name
of his firm or copartnership, or at the store, count-
ingroom or warehouse in his occupation or in the
occupation of his firm or copartnership or used as
his place of business, or as the place of business
of his firm or copartnership, without having first
obtained a "Special License" so to do, which
special license shall be in addition to the ordinary
" Trader's License" of such person or firm as now
required by law and shall license the person or
firm obtaining the same to permit his or their
regular consignors, their clerks or agents not be-
ing permanent residents of the city of Baltimore,
and not in his regular service or employ, or in the
regular service or employ of his firm or copartner-
ship, to sell goods, wares, merchandise in any of
the modes above described within the limits of the
city of Baltimore.

Special Li-
cense.

39. The license mentioned in the thirty-seventh
section shall be issued to the person applying for
the same on payment of the sum of three hun-
dred dollars, and the special license mentioned in
the thirty-eighth section shall be issued by the
Clerk of the Court of Common Pleas of Baltimore
city to any person or firm permanently residing
in said city and having a license to sell therein,
upon the application of such person or firm, and
upon payment by him or them of the same amount
paid by such person or firm for his or their own
ordinary "Trade License," and such special li-
cense shall expire on the first day of May next
following the issue thereof.

40. Any person offending against any of the
preceding sections, and any person selling under
the authority or permission of a person or firm
resident in the city of Baltimore as provided in
the thirty-eighth section, who shall sell other-
wise than in accordance with such authority or
permission, shall be liable to indictment, and upon
