SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the Hillen Road Company
of Baltimore county, created and incorporated by
the Act of January session, one thousand eight
hundred and fifty-four, Chapter ninety-nine, shall
if said company deem it necessary and proper,
have the power and is hereby authorized to change
the location of said road, and adopt and make
such location thereof as may be deemed most con-
venient and suitable for constructing and extend-
ing said road from its place of beginning to its
place of termination) as contemplated and autho-
rized by the second section of the Act of one thous-
and eight hundred and sixty. Chapter fifty-one. |

Sec. 2. And be it enacted. That said Company,
in making the road or railway authorized to be
constructed by the second section of the Act of
one thousand eight hundred and sixty, Chapter
fifty-one, shall have the power to make and con-
struct the same, with single or double tracks and
sidelings, such as may be deemed expedient for
horse or steam power, either or both of which
powers said company is at liberty to use in the
transportation of passengers, agricultural produce,
fertilizers, and every other description of freight,
and said road shall bo made with a width not
exceeding sixty feet, with the necessary additions
for excavations and embankments. |

Sec. 3. And be it enacted, That if the said Com-
pany cannot obtain the consent of the owner or
owners of ground to locate and make said road or
railway in such location as may be deemed judi-
cious and suitable, that then said company shall
have and exercise rights, powers and privileges
conferred upon and vested in the Baltimore,
Catonaville and Ellicott's Mills Passenger Rail-
way Company by the seventh section of the Act
of one thousand eight hundred and sixty, Chap-
ter thirty-four, for condemning and acquiring to
the use of said company such ground as might
be necessary to the construction of said road; and
the manner of proceeding in any such condemna-
tion or inquisition shall bo as set forth in the sev-
enth section of the Act last herein mentioned,.
except that a Justice of the Peace and Sheriff of
Baltimore county, and the Clerk and Judge of the |
