District No. 13, at the election on the 6th of November last :
to what political party do you belong ?
Answer. I was return Judge for District 13, at said elec-
tion—I belong to the Radical or Union party.
3d Interrog. When the polls were closed did you and your
associate" Judges publicly take the ballots out of the box, and
read distinctly and loud the name or names written or print-
ed thereon, respectively; and did the clerks of said election
carefully enter and keep an account of the same on the books
of the polls, so that the number of votes, for each candidate,
tallied thereon, could or might be readily cast up and known?
Answer. Mr. Brant took all the tickets from the box and
examined them. The split tickets were laid in another bal-
lot box, and I read distinctly and aloud the leading names on
each full ticket, and the party for which it had been cast; af-
ter reading the full tickets Mr. Brant handed me the split
tickets, on which I read every name. The clerks kept a cor-
rect account to the best of my knowledge; I cannot tell the
number of votes cast for each candidate for the Legislature.
4th Interrog. You state that Mr. Brant took all the tickets
out of the box, and handed them to you separately; how can
yon tell the number of deceitfully folded tickets ?
Answer. Mr. Brant handed me the three double tickets,
remarking the fact—I noticed they were folded double. He
told me of one other ticket at the time he handed it to me,
but thinking it had slipped together we counted it; we threw
out but three double tickets in making the return.
5th Interrog. As soon as the ballots were read off and
counted, and the number for each candidate ascertained, did
the Judges of Election make out, under their hands, attested
by the Clerks of Election, on the books of the polls, two
plain, fair and distinct statements, and certificates of the
number of rotes which were given for each candidate, distin-
guishing the station or office for which he had been voted ;
at the time the said certificates were made out, was there Any
thing said about- other than the three deceitfully folded tic-
kets thrown out ?
Answer. We made out said certificates the morning after
election day, in the room in which the election was held.—
There was no official notice taken of the deceitfully folded
tickets at this time.
6th Interrog. Did you, as presiding Judge of the Election
for District 13, meet your associates, presiding Judges, with
the books of the polls, and the above mentioned certificates in
the Court House for Allegany county, and did said Judges so
assembed, cast up the whole vote of all the district, and did
they make out statements and certificates of the number of
votes which had been given for each candidate?
