1st Interrogatory. What is your age, occupation and resi-
dence?

Answer. I am 45 years of age; .am a coal dealer, and re-
side in District No. 13, Allegany county, Md.

2d Interrogatory. Were you one of the Judges of election
for District No. 13, at the election on the 6th of November
last; to what political party do you belong ?

Answer. I was one of the Judges at said election in Dis-
trict No. 13, and belonged to the Union or Radical party.

3d Interrogatory. When the polls were closed did you and
yonr associate Judges publicly take the ballots out of the
box and read distinctly and loud the name or names written
and printed thereon respectively, and did the Clerks of said
election carefully enter and keep an Account of the same on
the books of the polls, so that the number of votes for each
candidate tallied thereon, could or might be readily cast up
and known ?

Answer. I selected the tickets from the box and after a
careful examination, passed them to the hands of Mr. Koer-
ner, one of the associate Judges, who read the leading names
and announced it to be a full ticket for either party; after
reading the full tickets, we read the split tickets, on which
every name was read; the Clerks kept the poll books correct
to the best of my knowledge and belief; I cannot tell the
number of votes cast for each of the candidates for the Legis-
lature, respectively.

4th Interrog. Are you positive of the number of ballots de-
ceitfully folded together; could there not possibly have
been a mistake made by the Clerks of the Election; how
many deceitfully folded ballots are you positive were de-
posited ?

Answer. I am not positive of the number of deceitfully
folded tickets, but am positive there were three, and think
there were three more. The clerks might possibly have made
a mistake, but to the best of. my knowledge and belief, the
record was kept correctly—we threw out three double tickets.

5th Interrog. Were there any deceitfully folded Radical
ticket ?

Answer. There were none.

interrogatories, by the contestants, deposes and says:
