Answer. 1 did meet with the other presiding Judges in the
Court House, and had with me the poll books and certificates.
The Judges made out, statements and certificates through a
clerk who was appointed.

7th Interrogatory. Did you notify your associate presiding
Judges of the deceitfully folded tickets, and was there any
official notice taken of it in your return ?

Answer. I notified them of the deceitfully folded tickets,
giving the number cast, counted and thrown out. There was
no notice taken of it in the return to the Governor, or in the
certificate handed to the Clerk of the Court, but there is in
the poll-book, for future reference.

THOMAS SHUCK, witness on the part of the contestants, be-
ing duly sworn and examined by interrogatories, deposes and
says:

1st Interrogatory. What is your age, occupation and, resi-
dence ?

Answer. I am 50 years old, a house carpenter, and reside
in District No. 13, Allegany county, Md.

2d Interrogatory. Were you one of the Judges of Election
for District No. 13, at the election in November last. When
the certificates of returns were made out, was there any dis-
cussion among your associate Judges in reference to deceit-
fully folded tickets, other than those thrown out?

Answer. I was one of the Judges of election. There was
no discussion, and I had no knowledge of other deceitfully
folded tickets than those thrown out in the returns, excepting
one which was mentioned by Mr. Brant, but which was coun-
ted.

Examination on the part of Respondents.

1st Interog. State why Lewis H. Soysters vote was rejected
by the Judges of election at the November election last.

Answer. His vote was rejected because I had heard him say
when the first Federal troops crossed the long bridge into
Virginia, that he hoped every son of a bitch of them might
be killed before they returned.

JOSEPH M. KOERNER, recalled on the part of contestants, de-
poses and says:

1st Interog. Was Mr. Lewis H. Soyster's name on the list
of registered voters handed the Judges of election by Mr.
F. O'Neall, the Register for 1866?
