TESTIMONY.
At the Court House, December 27th, 1866.

JOSEPH M. Koernea, being duly sworn and examined by in-
terrogatories, deposes and says:

1st Interrogatory. What is your age, occupation and resi-
dence?

Answer. I am 38 years of age; a wheelwright, and reside
in District No. 13, Allegany county, Maryland.

2d. Interrogatory. Were you return Judge for District
No. 13 at the election on the 6th of November last, and if so,
state whether the number of tickets in the ballot-box corres-
ponded with the number of persons voting, and if any dis-
crepancy, state the same fully?

Answer. I was return Judge for District No. 13, in Alle-
gaoy county, at the election on the 6th of November last;
there were more tickets in the ballot-box than there were
nanes recorded by the Clerks. The Clerks agreed in their
record of 843 persons having voted, whilst there 'were853
ballots in the box, three of which were folded double, making
six tickets, all of which double tickets were for the Conserva-
tive candidates in full; deducting the six tickets which were
thrown out entirely by the Judges, the number of tickets
strung was 847, being four more tickets than the record of
the Clerks called for. JOS. M. KOERNER.

Lsvi W. BRANT, being duly sworn and examined to the
some interrogatories that were proposed to Joseph M. Ker-
aer, says:

Answer. I am 45 years of age; am a coal dealer, and re-
side in District No. 13, Allegany county, Maryland; I was
one of the Judges of ejection in District No. 13, at the elec-
tion-held on the 6th of November last; I took each ticket out
of the ballot-box and handed it to J. M. Kerner, who read
the same for the Clerks to tally. The number of tickets in
the ballot-box was 853, whilst the record of the Clerks called
for but 843; there were three- double tickets which were
thrown out by the Judges, making six tickets in all, which
were full Conservative tickets; these being deducted, the whole
number of ballots strung was 847. In taking the tickets from
the box I noticed three other tickets which, in my opinion,
were deceitfully folded, but not being positive of the fact, I
passed them with the others to J. M. Kerner, when they
were read and tallied; these., likewise, were full Conserva-
tive tickets. L. W. BRANT.

At the office of Jacob Brown, Esq., December 29th, 1866.
Levi W. Brant, being re-sworn and cross-examined by
interrogatories, by the contestants, deposes and says :
