whose names were on your ticket as candidates for House of
Delegates ?

Answer. I did not attend said election; I call myself a
Union man; I heard reports, generally rumored, that an
armed force would be at the polls, and I expected a disturb-
ance at the polls. If I had voted at all, I would have voted
as candidates for House of Delegates, for Wm. Devecmon,
Wm. A. Bryden, John McElfish, George W. McCulloh and
Patrick Hammil; I was sworn to the United States in 1840.

Cross-examined by Mr. Brown.

1st Question. Did you see either ticket during the election,
and do you .know the names on either ?

Answer. I saw neither, and don't know the names on
either. I would have voted the ticket that Patrick Hammil
was on, I knew Mr. Hammil was a candidate; I did not think
it would profit me to go to the election; I never heard any
thing of a company coming from Virginia to be at the polls.
There was no doubt both sides were prepared, and afraid to
fight.

Deposition No. 58.

TOBIAS S. FISHER, being duly sworn, deposed and said as
follows, to wit:

By Mr. Devecmon :

1st Question. What is your name, age, residence and occu-
pation ?

Answer. My name is Tobias S. Fisher; age, 26 years; re-
side in District No. 10, Allegany county, Maryland; and am
a teacher by profession,

2d Question. Do you know any thing about an organiza-
tion of an armed force in No. 10, previous to the election No-
vember 6, 1866.

Answer. Aboiut the 27th of October, 1866, the Radicals in
No. 10, held a meeting to organize a squad or company of
men to go to the polls on November 6, 1866, to protect the
polls; these men were to go to the polls armed, and officers
to the company were elected, I was at the meeting mention-
ed, and the ballots for officers were secret, and were counted,
but the officers so-elected were not mentioned openly; I am
from Pennsylvania, and was in District 10 temporarily teach-
ing school.

3d Question. Did Dr. Charles H. Ohr counsel such a meet"
ing and organization?

Answer. Dr. Ohr and Captain Falkensteine were present
at the meeting held on October 23d, 1866, the Tuesday pre-
