3d Question. Did you attend the election held in District
No. 3, Allegany county, Md., Nov. 6th, 1866; did you offer
to vote; was your vote accepted or rejected, and whose names
were on your ticket as candidates for the House of Dele-
gates ?

Answer. I attended said election, offered to vote, but my
vote was refused by the Judges of Election, they saying there
was a paper lodged with them having charges against me ;
the names on my ticket as candidates for the House of Dele-
gates were, Wm. A. Bryden, Win. Devecmon, John Mc-
Elfish, George W. McCulloh and Patrick Hamil.

Cross-examination by Mr. Brown.

1st Question. Did the Judges request you to take any
oath ?

Answer. They did not.

2d Question. At what time in the day did you offer to
vote ?

Answer. Shortly after the polls were opened; the Judges
said they must examine a paper containing charges against
me and lodged with them; they rejected my vote by reason
of the charges made against me; they said the charge was
this: That about the commencement of the war, Benton
White came to Cumberland for the purpose of going South,
and that I had persuaded him to go South; I never did per-
suade him, or any one, to go South; there were no charges
against me before the Register, when I registered in Septem-
ber, 1866; I did not register in 1865, because my wife per-
suaded me not to do so, as it would create a difficulty between
White's family and ours; I never made application to be
registered in 1865; I don't know whether I was entered on
the Registration books in 1865; I offered to prove before the
Judges of Election that the charges made against me were
false, but they refused to hear it.

1st Question. What is your name, age, residence and occu-
pation ?

Answer. My name is Jeremiah Guard; age, 52; live in
District No. 2, Allegany county, Md., and am a merchant by
occupation.
