names were on your ticket as candidates for House of Dele-
gates ?

Answer. I attended said election November 6,1866, offered
to vote, but the Judges refused my ticket, and said I could not
vote, giving me no reason whatever except they said my name
was on the list, having asked Mr. Kitzmiller if it was; the
names oi the parties on my ticket as candidates for House of
Delegates were Mr. Devecmon, Wm. A. Bryden, John Mc-
Elfish, George W. McCulloh and Patrick Hammil.

Gross-Examined by Mr. Brown.

1st Question. Do you know anything about the list you
mentioned.

Answer. I do not, the Judges did not show it to me; I did
not register in 1865, because I did not suppose they would let
me register, was busy and did not apply, others like me had
applied and could not register.

H. O. HAMILL.

There being no other witnesses produced before me now,
and no further time being required by the said contestants
for the production of evidence here, I closed the taking of tes-
timony at this place, this 6th day of December, 1866.

J. B. WIDENER,
Justice of the Peace.

CUMBERLAND, ALLEGANY COUNTY, MD.,

December 10, 1866.

Pursuant to the notice aforesaid, I attended also at the time
and place secondly therein named, and having appointed
Joseph A. Cahill, as Clerk, and administered to him an oath
to fairly write down and transcribe the depositions to be taken
by me, did proceed then and there to take the following tes-
timony, to wit:

lows, to wit:

pation ?

trict No. 3, Allegany county, Md., and a hotel keeper by occu-
