Answer. It is, but they never before acted as they did on
November 6th,-and I never before saw them carry revolvers.

5th Question. Did the Judges ask you to take the oath ?

Answer. They did, and I declined, on the ground that I
had taken it before the Register, when I was registered. It
was the same oath. The Judges refused my vote because I
declined to take the oath before them, and said I could vote
if I would take it, as they had no charges against me.

6th Question. Did you ever give any aid or comfort to the
enemies of the United States ?

Answer. I never did.

Re-examined by Mr. Devecmon.

1st Question. Were not these armed men at the polls for
the purpose of intimidating men from voting ?
Answer. I think so.

Deposition No. 3.

FRANCIS MARTIN, being duly sworn, deposed and said as
follows, to wit:

By Mr. Devecmon:

1st Question. What is your name, age, residence and occupa-
tion?

Answer. My name is Francis Martin, age 44, reside in
Dist. No. 10, Allegany county, have lived there 38 years,
and by occupation a farmer ?

2nd Question. Were you registered as a voter prior to No-
vember 6th, 1866 ?

Answer. I was registered on (September 11th, 1866.

3rd Question. Did you or not attend the election held in
Allegany county, November 6th, 1.866, and if so, did you
then and there offer to the Judges of Election a ticket as your
ballot, and was it received or rejected; and state the names
of the parties printed on said ticket as candidates for the
House of Delegates ?

Answer. I did attend said election, and did offer my ticket,
and it was rejected. The names of the parties on said ticket
were Patrick Hammil, George W. McCulloh, William A.
Bryden, John McElfish and William Devecmon.

4th Question. Were there any armed men at the polls ?

Answer,. There were. They stood at the door and other
places, and this had a tendency to intimidate voters. These
men belonged to the Radical party. The Judges asked me
to take the oath, and I declined on the ground I had taken it
before the Register; they said, "You've taken it once, and
