Strike out 9th section to word "and," in line 8, and insert:

"9. The general Staff of the militia of this State shall
consist of an Adjutant General, who shall be appointed by
the Governor, by and with the advice and consent of the Sen-
ate, and shall hold his office at the pleasure of the Governor,
an Inspector General, to be elected by the General Assembly
as aforesaid, each of whom shall rank as Major General; a
Judge Advocate General, a Paymaster General, a Quar-
termaster General, a Surgeon General and a Commis-
sary General, who shall each rank as Brigadier General, and
who shall be commissioned by the Governor, on the nomina-
tion and recommendation of the Military Board, which is
hereby created, to consist of the Adjutant General, Inspector
General and the Comptroller of the Treasury, and the In-
spector General, Judge Advocate General, Paymaster Gen-
eral, Surgeon General and Commissary General, shall hold
their respective commissions until trial and conviction by
court martial.

Mr. Clarke proposed the following amendment:

Sub-sectioni2, after the word "Treasurer," in line 4, strike
out all to and including the word "States," in line 12.

Mr. Jones proposed the following as a substitute for the
amendment proposed by Mr. Clarke:

Strike out after Treasurer, in fourth line, to physicians, in
tenth line.

Which was rejected.

Mr. Nicolai proposed the following amendment:

Section 26, Provided, that nothing contained in this Act
shall be so construed as to refer to persons of color.

Mr. Neilson moved the previous question;
Which was sustained.
The question then being,
"Shall the previous question be now put ?"
It was sustained.

The question then recurring upon the amendment proposed
by Mr. Clarke;

It was adopted.

The question then recurring upon the amendment proposed
by Mr. Nicolai,

It was adopted,

And the bill as amended was then read a second time and
ordered to be engrossed for a third reading.
