So the resolution was rejected.
The question then recurring upon the amendment proposed
by Mr. Evans as a substitute for the majority report;
Resolved, That Samuel M. Haller was not duly elected a
delegate from Allegany county, to this House, and is there-
fore not entitled to a seat therein.
Resolved, That William Devecmon having received a higher
number of votes than Samuel M. Haller, is hereby declared
duly elected and duly entitled to a seat in this body as a de-
legate from Allegany county;
