The House then resumed the consideration of the order of
the day.

The question being upon the substitute proposed by Mr.
Evans, for the majority report of the committee,

Mr. Baker submitted the following :

Being the report of the minority of the Committee on
Elections on the right of the sitting members from Allegany
to seats in this House:

Resolved, That the memorial of William Devecmon and
others contesting the right of William R. McCulley and
others to seats as representatives in this body, be and is hereby
dismissed;

Pending which,

Mr. Beck moved the previous question.

On motion of Mr. Clarke,
A call of the House was ordered, when
The following members responded to their names:

Messrs. Miller, Speaker, Morgan, Beck, Welch, Hall,
Clarke, Cameron, Hutchins, Ford, Shipley, Davis, of Charles,
Thomas, Jump, Jooes, Dennis, Parsons, Kerr, Evans,
Lindsey, Magruder, Calvert, Rouzer, Buhrman, Baker,
Linthicum, Gorsuch, Steiner, Appleman, Tobey, Bishop,
Hutton, Coleman, Neilson, Smith, Flaherty, Robson, Hooper,
Israel, Knott, Lankford, Thomson, Waltemeyer, Feig, Bizler,
Pitts, Aydelott, Gordy, Nelson, Wilson, Spicer, Gilpin,
McCulley, Haller, Brace, McCulloh, Neale, Benton, Criswell,
Wampler, Gore, Horsey, King, Hammond—60.

Mr. Ford moved that all further proceedings under the call
be dispenced with;

Which was not sustained.

On motion of Mr. Magruder,

The Sergeant-at-Arms was ordered to notify the absent
members to give their attendance, and to bring them before
the bar of the House. After some time the Sergeant-at-Arms
returned and reported that he had brought before the bar of
House all the absent members now in the city;

On motion of Ford,

All further proceedings under the call were dispensed
with.

The question then recurring upon the motion of Mr. Beck,
Being the demand for the previous question;
It was sustained.
