him paid for the mare, and therefore, the above sum of seven-
ty-five dollars, is justly due to the said Philip Doffert.

August 30, 1865.

I, Philip Doffert, do on oath state that in the Fall of 1862,
Thomas West and others, came to my House, and on the
same evening I was called away on business belonging to
family affairs; when, on the day following, I was at Mrs.
Broberts, and my wife came down and said: "the party had
left and taken my mare along with them." In the evening,
George O'Bryan met me on my road home, and said : "I will
pay you for your mare if Truman West don't." And at dif-
ferent times afterwards told me to the same effect. About the
number collected at my house to go South, I think was five,
these parties some I know and some I did not know.

PHILIP DOFFERT.

Interrog. 14. Look upon the paper shown you marked S.
W. Friend, and state whose hand writing it is, before whom
is it sworn to, and by what authority had the party signing,
to administer said oath ?

Answer. In my hand writing; sworn before me as Register,
appointed by the Governor of the State of Maryland, date
August 30, 1865, and taken in the office of registration; Mr.
O'Brien was not present when this affidavit was made.

Interrog. 15. Whose names were on the list of the parties
to be challenged at the polls, and who furnished said list?

Answer. P. Hammill, H. O. Hammill, Henry Hammill,
Sr., Archibald Hammill, Alexander Farrall, Richard J.
West, Reason Turner, and Geo. O'Brian; it was furnished by
E. Blackburn, Hagans, J. L. Browning and others.

Interrog. 16 Did you, or not, publicly declare before said
election, that certain parties who were registered in 1866.
should not vote; and had you a list of said persons at the
polls.

Answer. I have no recollection of making such a declara-
tion, I had a list of eight persons handed me at the polls, be-
fore any votes were taken.

Interrog. 17. Did you, or either of the Judges of Election
call any person or persons in side the poll room, and there or
at any other place, solicit him or them, to vote the Radical
ticket.

Answer. To the best of my knowledge it was not done.
