testimony against him, but never recorded; if I recollect
right it was a violation of the 4th section of the Constitution,
Article 1st.

Interrog. 11th. Was that entry made on the book of reg-
istration ?

Answer. Not in that way; the entry that was made was,
generally known to be disloyal, under the circumstances we
thought that that was as good a way as any to enter it.

Interrog. 12th. What were the charges against George
O'Brien; and was he before you for registration ?

Answer. They were thathe furnished a horse for Thos. West
to go South; and that he harbored and fed Hiram Talker,
Charles West and others on their return from the South; ac-
cording to my recollection he was before me for registration.

Interrog. 13th. Do you know, of your own knowledge,
whether these charge are true or false ?

Answer. The charge of having fed West and Tasker on
their return from the South, he told me was true, but thathe
did not know it was wrong. I do not know that he fur-
nished the horse, exceept by the testimony that appeared be-
fore me as Register.

Interrog. 14. Where is that testimony; if you have it, pro-
duce it ?

Answer. Affidavit of Phillip Doffert, produced and filed,
marked exhibit S. W. Friend.

STATE OF MARYLAND,

ALLEGANT COUNTY, to wit:

Personally appeared before me, the subscriber, a Justice of
the Peace in and for said county, Joseph Miller, who after
being duly sworn according to lawj says and declares on his
oath, that Geo. O'Brian told him, the said Joseph Miller, on
the Evening of the 24th of August last, that he, the said,
Geo. O'Brian, "had promised and pledged his word and honor
to see Philip Doffert paid for his mare, if he would let Thos.
West have the Mare." I heard the said Geo. O'Brian, re-
peat several times afterwards that he had promised his word
and honor, and would see Phillip Doffert paid for the mare;
and I know that the said Doffert never would have given the
mare without this repeated promise of Geo. O'Bryan, to see
