the rear of the Clerk's office. The ballots were all in good
condition except, probably, two or three; they from some
cause were probably detached. The ballots and poll books
were not tied together. We counted the ballots to ascertain
the number of votes, and compared it with the poll books.—
At the time of the recount J. H. Young, T. A. Ogle, H. D.
Carleton, George Hoover, Thomas E. Gonder and Mr. A.
Spates, and the two deputy Clerks were present. The de-
tached poll books and tickets of the two Districts agreed in the
count; the number of ballots agreed with the number of
names on these poll books.

Mr. A. Spates makes the following statement, and admits
it to this record as the testimony of George W. McCulloh.

He was present when the tickets were counted out at Frost-
burg District No. 5, and he thought the count was carefully
and correctly made; he did not examine or see the tickets,
or keep a tally of the count made; he can only speak from
observation, having no personal knowledge.

Interrogatory 1st, of schedule A.—T. A. Ogle, age 40
years, occupation saddler, residence in electien District No. 6,
in Allegany county, and have resided there 10 years.

Interrogatory 2d, as in schedule A. I was appointed, did
qualify and act as such officer of Registration for the year
1866. I qualified before the Clerk of the Circuit Court for
Allegany county. I had read the Constitution and laws re-
lating registration. I did administer the oath to each and
every one. I gave notice of the time and place of registration
as required by law.

Interrogatory 3rd, as interrogatory 4, in schedule A.

Answer. I did so enter. I did register some who had le-
gal residence and were of lawful age, before said 1st day of
November, 1865. I registered a great many of that kind;
C. W. Blengle, J. W. Jones, Dr. James M. Smith, J. B.
Widner, G. B W. Rossee and others. I considered them en-
titled to register under the provisions of the regisry law. I
had no one's advice as to registering.

Interrogatory 1st, as in schedule A. Will Lowdermilk. age
28 years, occupation publisher, residence in election District
No. 13, of Allegany county, Maryland, have resided there 18
months.

Interrogatory 2d,. Did you publish the list of registered
voters for any of the election Districts, of Allegany county, in
