WM. CONRAD, (sworn) :

Interrogatory 1st, as in Schedule D, he answers and says :
Wm. Conrad, my age 69 years, my occupation contractor,
my residence Frostburg, Election District No. 5, Allegany
county, Md., and have lived there five years or more.

Interrogatory 2nd, as in Schedule D, he answer and says :
I was appointed Judge of Election District No. 5 and did
qualify and act as such Judge; after closing the polls I did
read between three and four hundred of said ballots, and re-
quested Mr. Hoblitzell to look over my shoulder; I saw the
votes carefully tallied and counted; I saw the clerks write
down the true number of votes cast for Alfred Spates and C.
H. Ohr, respectively, for State Senator; I did return the said
identical ballots to the Clerk of the Circuit Court for Alle-
gany county; Mr. Benjamin Thomas took them out of the
box, and I read them slow, and then handed them to Wil-
liam Staples, the other Judge, to be strung. Mr. J. J. Hob-
litzell, G. W. McCulloh, C. Douty, D. C. Bruce and M.
Sherry were present at their reading.

Interrogatory 3d, as in Schedule D, he answers and says :
The ballots did agree with the names of the voters.

Cross-questioned by A. Spates.

To the first cross-interrogatory to William Conrad on the
part of A. Spates, he answers and says : I did act as Return
Judge for that district, and I and my fellow Judges did make
a true return of the number of votes cast for each party voted
for, respectively; we signed the return, and I returned it to
the Clerk's office as Return Judge.

To the second interrogatory to William Conrad on the
part of A. Spates, he answers and says : Returns shown to
the Judge of Election District No. 5, who admits that it is
his handwriting to the returns, but that the Senators were
omitted from the certificate; A. Spates files a certified copy
of said return, as shown to the witness.

Re-examination of William Conrad.

Interrogatory 4th of Schedule D :

(Excepted to by A. Spates.)

R. W. Mason and John C. Wise, who acted as clerks at
said election, Mason a Radical and Wise a Democrat.

WILLIAM CONRAD.

Re-examination of M. W. Mason.

Interrogatory 1st. How did it happen that you omitted
the vote for Senator, in your certificate or return of votes
polled at the election in District No, 5, held on the 6th of
November, 1866 ?
