Answer. John C. Wise, the other clerk, drew up the certi-
ficate attached to his poll book, and I intended to copy the
certificate from the Code; he handed me the certificate he
had written, from which I copied; he signified 'twould be
handier than to copy from the book.

Cross-examination of E. W. Mason by A. Spates.

Question. At what time did you finish counting the tick-
ets, and who had charge of the tickets and ballot box from
the time you closed counting until.you saw Mr. Wise making
out said returns referred to; and were any of the Judges of
Election present at the time when Mr. Wise wrote said certi-
ficate referred to by you?

Answer. Closed I think, about ten o'clock P. M. Wm.
Conrad took charge of the ballots and the ballot box, but
don't know what he did witn them; did not make out the
certificate of returns that night. I don't think any Judges
of Election were present when Mr. Wise was making out
this certificate of Returns as referred to; do not think that
there were any of the Judges of Election present when I
made out my certificate, and I did not see any of the Judges
sign the certificate of return; the certificates were made out
the morning after the election.

CALEB DOUTY, (sworn) :

Interrogatory 1st, as No. 1, in Schedule D. Caleb Douty,
age 47, occupation merchant, residence Frostburg, Allegany
county, Md, and resided there nine months.

Interrogatory 2nd, as No. 5 in Schedule D. I was at the
polls in the morning and voted; I was in the room during
the later part of the counting.; there was a great deal of care
exercised during the counting and tallying of the ballots; one
of the Judges sat at the box, took out the ballots, opened them,
and handed them to the second Judge, who read each name sep-
erately, and was strung by the 3d Judge; I am a Radical,
and voted for Dr. C. H. Ohr.

Cross-examination of G. Douty by A. Spates.
Question. Did you or not keep a tally of the votes or bal-
lots you saw counted out while present in said room ?
Answer. I did not.

J. J. HOBLITZELL, (Sworn.)

Interrogatory 1st. As No. 1, in Schedule D. Jas. Jacob
Hoblitzell, age 35, residence Frostburg, Allegany county,
Maryland, occupation saddler, have resided these 7 years.
