ernor of Maryland, to act as register in Allegany county, if so,
did you take an oath for the faithful performance of said duty
before the clerk of the Circuit Court of Allegany county ?

Answer. I received a commission from the Governor com-
missioning me as register, but did not take any oath for the
faithful performance of said duty before the clerk of the Cir-
cuit Court of Allegany county, but before a Justice of the
Peace.

Deposition No. 2.

HENRY R. ATKINSON, (Sworn.)

Interrogatory 1st. To Interrogatory 1st, as in schedule A, he
answers and says, Henry Richard Atkinson, age 46 years, oc-
cupation clerk, residence, Election District No. 5, in Alle-
gany county, Maryland, I have resided 5 years, in that Dis-
trict ?

Interrogatory 2nd. To Interrogatory 2nd, as in schedule A,
he answers and say;

I was, I did in 1866, I had, I did, I did.
Interrogatory 3rd. To Interrogatory 3rd, as in schedule A,
he answers and says;

(Excepted to by Mr. A. Spates.)

I did enter some in the eighth column that had been rejected
by the registers the year before, my reason for so doing was
because there was not sufficient evidence before me in my
judgement to disqualify them, about ten in number, all of
which will appear by the book of registration, returned to the
clerk of the Circuit Court of Allegany county.

Interrogatory 4th. To Interrogatory 4, as in schedule A, he
answers and says;

I did enter the names of some who had not been registered
before.

Interrogatory 5th. To Interrogatory 5th, as in schedule A,
he answers and says: I was registered before the 1st day of
August 1866, and I did vote for Alfred Spates for State Sen-
ator ?

Cross-questioned by A. Spates.

I did receive a commission from the Governor to act as re-
gister in Allegany county, and I qualified before the clerk of
the Circuit Court of Allegany county, on the 27th day of July
1866, within 30 days from the date of the commission, and
here produce the record of qualification.
