Showing a majority in Col. Spates' favor of thirty-five
(35) votes, over Dr. Ohr for State Senator.

Cross-examined by Dr. Ohr.

By Dr. Ohr:

Question. State in what this count differed from the re-
turns made by the Judges?

Answer. In District No. 5, the count by the Judges was
296 votes for Spates, in the re-count made by myself and
others, it was 307 votes for Spates; in the return made by the
Judges, 399 votes were for Dr. Ohr; in the re count made by
myself and others, it was 390 votes for Dr. Ohr. In District
No. 6, the count made by the Judges was 352 votes for Spates,
in the re-count made by myself and others, it was 355 votes
for Spates; in the returns made by the Judges, 225 votes were
for Dr. Ohr, in the re-count, it was 219 votes for Dr. Ohr.
In District No. 12, the return made by the Judges of votes
for Col. Spates was correct; for Dr. Ohr, it was 102 votes made
by the Judges, the re-count made it 101 votes for Dr. Ohr. In
District No. 13, the return made by the Judges, was 449
votes for Spates, in the re-count, we made it 452 votes for
Spates; the Judges returned in this District, 383 votes for
Dr. Ohr, and the re-count made it 372 votes for Dr. Ohr.
All the other Districts were correctly counted by the Judges.

Deposition No. 2.

JOHN H. YOUNG, having been by me duly sworn, deposed
and said as follows, to wit:

By Mr. Spates:

Question. What is your name, age, occupation and resi-
dence?

Answer. My name is John H. Young; age 51 years, occu-
pation, Postmaster at Cumberland, where I reside.

By Mr. Spates:

Question. Did you or did you not examine and count cer-
tain ballots and inspect the poll books filed therewith in the
office of the Clerk of the Circuit Court for Allegany county,
on the 17th day of November, 1866; if yea, state at whose in-
stance you did so; who assisted you and what was the result
of such count and inspection; state your knowledge fully ?
