Answer. On the 17th day of November, 1866, at the re-
quest of Col. A. Spates, I was invited to the Clerk's office of
Allegany county, for the purpose of assisting to count and
inspect the ballots from the 16 election Districts of Allegany
county, to ascertain the number of votes given for Dr. Ohr
and Alfred Spates, for the Senate of Maryland; when I came
to the office, I found Messrs. Gonder, Adams, Ogle, Hoover,
Carleton, Col. Spates and also Mr. Bevans and Mr. Bean,
deputy Clerks in the Clerk's office.

The ballots and poll books were handed to us, severally,
when we commenced to count the ballots, Messrs. Gonder
and Adams calling the names, myself looking on to see that
the name given was correct on the ballot, Mr. Hoover and Mr.
Ogle were the tellers. After the whole number of tickets
were counted, and the tellers agreeing in their count, the
result was as follows, namely: 2,342 votes for Spates, and
2,307 votes for Dr. Ohr, precisely as testified to by Henry D.
Carleton, just examined.

Cross-examination by Dr. Ohr waived.

Deposition No. 3.

A. M, ADAMS, having been by me duly sworn, deposed and
said as follows, to wit:

1st Question by Mr. Spates :

Question. What is your name, age, occupation and resi-
dence ?

Answer. My name is A. M. Adams, aged 50 years, occu-
pation teacher, and residence Cumberland, Maryland.

2nd Question by Mr. Spates:

Did you or did you not examine and count certain ballots
and inspect the poll books filed therewith in the office of the
Clerk of the Circuit Court for Allegany county, on the 17th
day of November, 1866 ? if so, state at whose instance you
did so, who assisted you, and what was the result of such
count and inspection ? State your knowledge, fully.

Answer. I was requested by Col. Spates to come over and
assist in counting the tickets; Messrs. Ogle and Hoover acted
as tellers; Mr. Young and Mr. Carleton acted as inspectors ;
the ballots shown us were counted and tallied, in the Clerk's
Office, in our presence; and, to the best of my recollection
now, having taken no note of it, Col. Spates had a majority
of the votes so counted, of thirty-five or thirty-seven votes
for State Senator; I have just heard the testimony of John
