Deposition No. I.

HENRY D. CARLETON, having been by me duly sworn and
examined, deposed and'said as follows, to wit:

By Mr. Spates:

1st Question. What is your name, age, occupation and re-
sidence ?

Answer. My name is Henry D. Carleton; age 58 years ;
occupation bailiff to the Corporation of Cumberland; resi-
dence in Cumberland, Maryland.

By Mr. Spates:

2d Question. Did you or did you not examine and count
certain ballots and inspect the poll books therewith filed in
the office of the Clerk of the Circuit Court for Allegany
county on the 17th day of November, 1866; if so, state at
whose instance you did so, who assisted you and what was
the result of such count and inspection ? State your know-
ledge fully and at large ?

Answer. At the request of Colonel Spates, I went to the
Clerk's office in Cumberland, and assisted in the inspection
and count of tickets produced there and shown to me, on
Saturday the 17th day of November, 1866. Charles F. Bean,
produced to those assembled there, to wit: John H. Young,
Thomas E. Gonder, Theodore A. Ogle, George W. Hoover,
and A. M. Adams, the tickets and poll books of the sixteenth
election District, in Allegany county, returned by the Judges
of the eleetion held November 6th, 1866; the tickets cast or
voted in each election District, were counted seperately, com-
mencing with election District No. 1; the part I performed
was the inspecting each ticket as called off and counted, so as
to see that the count was correct. I know that the names
were called out correctly by the person who called out the
names printed on the tickets so examined; the names printed
on the ballots, were called out by A. M. Adams and Thomas
E, Gonder. Theodore A. Ogle and George W. Hoover,
acted as tellers in scoreing and keeping the tally or count.

The result as ascertained by the whole count, inspection
and tally, was as follows :
