Answer. I did attend at the polls on the 6th of November,
1866, in my District, and I offered my ticket to the Judges of
Election, at the polls and they would not receive it. The
name of the person printed on my ticket so offered as State
Senator, was Alfred Spates. I offered my ticket to Mr. Friend,
one of the judges, and he looked at me, and then looked at
Mr. Kitzmiller, one of the other judges, and asked him if I
was not on that list. Mr. Kitzmiller said that I was, and
that he would not receive my ticket.

Cross-examined by Dr. Ohr.

By Dr. Ohr:

Question. Do you or not know whether your name was en-
tered on the registration book of 1865, and what entry was
made opposite to it?

Answer. I do not know, and have no knowledge of it.

By Dr. Ohr:

Question. Did the said judges require you to take an oath
or do any other thing, before they rejected your vote?

Answer. They did not.

No other witnesses being produced by either parties, the
examination is closed, at this place.

appointed said James J McHenry, my clerk, and administer-
ed to him an oath to fairly write down and transcribe the
depositions to be taken by me, did proceed then and there to
