Spates; the reason assigned by said Judges for rejecting my
vote, was that there were charges against me, and I did not
vote.

By Alfred Spates :

Question, To which of the political parties did the Judges
of election in District No. 1 belong and what are their
names ?

Answer. They belonged to the party called Radicals; their
names are Samuel W. Friend, Ebenezer Kitzmiller and Wil-
liam W. Bray.

By A. Spates:

Question. Do you know any other matter or thing that
would be of benefit to the contestant in this case ?

Answer. I may say that the polls were held not at the
usual place of holding the elections in that District.

Cross-Examined by Dr. Ohr.

My Dr. Ohr :

Question. When were you registered as a voter?

Answer. I was registered as a voter in 1866; I don't re-
member the precise date.

By Dr. Ohr:

Question. Did you apply for registration in 1865 ?

Answer. I did not.

By Dr. Ohr:

Question. Do you or not know that you had then been
registered as disqualified for disloyalty ?

(Question objected to by A. Spates.)

Ani-wer. I did not know it in 1865; I knew it in 186f>,
when I applied for registration.

By Dr. Ohr.

Question. Did or did not the Judges of election in Novem-
ber, 1866, demand of you to take the oath prescribed in the
Constitution, Article 1, section 4, before deciding upon your
right to vote ?

Answer. They did.

By Dr. Ohr:

Question. Did you or not decline to take said oath ?

Answer. At first I did, but afterwards I did take said oath.

By Dr. Ohr :

Question. Did you after taking said oath, tender your bal-
lot ro the said Judges and was it then rejected by them?

Answer. I did not.

By Dr. Ohr:

Question. Was notice of the place of holding said election
posted or given by the Sheriff or by his authority; and was
the election held at the place designated in said notice ?

Answer. I do not know.
