Deposition No. 2.

JOHN PHILLIPS, having been by me duly tstforn, deposed and
said as follows, to wit:

By Mr. Spates:

Question. What is your name, age, occupation and resi-
dence?

Answer. My name is John Phillips; age 52 years; occupa-
tion farmer; residence in District No. 10, in Allegany county,
Maryland, and have lived there seven years.

By Mr. Spates:

Question. Were you registered as a voter prior to the elec-
tion held in said Allegany county, on the 6th day of Novem-
ber, 1866?

Answer. I was.

By Mr. Spates :

Question. Did you or not attend at the polls in said Elec-
tion District No. 10, in Allegany county,, on the 6th day of
November, 1866; if so, did you then and there offer a ticket
to the Judges of Election at said polls as your ballot; and
was it received or rejected; state also the name of the person
for State Senator printed on said ticket, and for whom you
desire to vote; and what reason did the said Judges assign
for rejecting your vote, if they did so reject it ?

(Objected to by Dr. Ohr.)

Answer. I did so attend and offered my ballot, and it was
rejected by the Judges of Election peremptorily and immedi-
ately. Alfred Spates was the name of the person on my bal-
lot, for whom I desired to vote for State Senator. The reason
the Judges assigned for so rejecting my vote was that there
were charges.

By Mr. Spates:

Question. To which of the political parties did the Judges
of Election in District No. 10 belong, and what are their
names ?

Answer. They are Abolitionists, sir; their names are Jas.
Chisholm, Sr., William Waltz and George S. Lee.

By Mr. Spates:

Question. Do you know any other matter or thing that
would be of benefit to the contestant in this case ?

Answer. I know there were many armed men there at the
polls who intimidated other persons from offering their votes.

By Mr. Spates :

Question. To which of the two political parties did said
armed men belong ?

Answer. To the Abolitionists, or Radicals, as they are
called.
