the said Charles H. Ohr, addressed a public political meeting
in District No. 10, of said county, and then and there, in
your said speech, counseled and advised your political friends
to arm themselves on the day of election and to prevent all
persons from voting at said election who were not duly regis-
tered in the year 1865. And you are further notified as afore-
said that at the same time and place first aforesaid, the fol-
lowing named witnesses will be examined, viz: Israel Thomp-
son, Henry Thompson, J. McClure Masol, Charles Best, John
Phillips, David S. Arnold. By these witnesses Alfred Spates
expects to prove that on the day of election in District No.
10, in said county, a large number of men of radical politics
were at the polls, armed with guns and pistols, and by their
threats, violence and deportment intimidated and prevented
a large number of the legal, registered and qualified voters
of said district from offering or tendering their ballots or
votes to the Judges of the election who would have voted for
Alfred Spates for State Senator.

And you are further notified as aforesaid, that at the same
time and place first aforesaid, the following witnesses will be
examined, viz . John Beard, George N. Gower, James F.
Siller, George Mossey, David E. Hauser, John Paugh, Abra-
ham Haun, Frederick P. Sauser, Benjamin F. Shaffer, Jacob
Shaffer, John N. Gower, George H. Gower, George McCor-
mick, John C. Nithkin, Ezra Hauser, James E. Paugh, Isaiah
Haun, John Ridder, Jr. John Ridder, Sr. and Elliott C.
Tabb. By these witnesses Alfred Spates expects to prove that
each and every of them reside in District No. 10 of Allegany
county, and were duly registered as qualified voters in said
election district, and that as such qualified voters they sever-
ally attended at the polls on the day of election held in Alle-
gany county on the 6th day of November, 1866, for the pur-
pose of voting for him, the said Alfred Spates, for State Sen-
ator, and were each and every of them prevented from voting
at said election by reason of the threats and violence of a large
number of armed men who were present at the polls.

And you are further notified as aforesaid, that the follow-
ing named witnesses, viz : A.M. Adams, Theodore A. Ogle,
Thomas E. Gonder, George W. Hoover, Henry D. Carleton,
Jonn H. Young and Charles F. Bean, Deputy Clerk of the
Circuit Court for Allegany county, will be examined at the
Court house, in the city of Cumberland, on Monday, the 10th
day of December, 1866, at 11 o'clock. By these last named
witnesses Alfred Spates expects to prove that the said wit-
nesses did, on the 17th day of November, 1866, in the Clerk's
'office in Allegany county, in the presence of the Clerk of the
Circuit Court, carefully count all the tickets and ballots voted
in each and every of the election districts in Allegany county
at the election held on the 6th day of November, 1866; and
that upon said careful count they found that twenty-three
