Summons under Code of Public
vs • General Laws, Maryland.—Con-
tested Election.
DR. CHAS. H. OHR.

SIR : You are hereby notified, in accordance with the pro-
visions of section 57 of the 35th Article of the Code of Pub-
lic General Laws of Maryland, that an examination of the
following witnesses, viz: J. McClure Mason, Charles Best,
William H. Kitzmiller, John Conneway, Jacob Gower, John
Gower, Charles Nithkin, William Arnold, David A: Gower,
Henry O. Hammil, Henry Hammil, Sr., Resin Turner, Fran-
cis Martin, William H. Moon, J. P. Gower, George S. Mos-
sey, Henry Thompson, John A. Gower, Lloyd Kitzmiller,
David S. Arnold, John Whirel, John Phillips, Alexander
Fairall, Patrick Hammil, A. C. Hammil, George O'Brienand
Richard J. West, will take place at the "Glades Hotel,"
kept by Mr. John Dailey, in the town of Oakland, Allegany
county, Maryland, on Wednesday, the fifth day of December,
1866, at ten o'clock A. M. By these witnesses, Alfred Spates
expects to prove that the said witnesses hereinbefore named
were each and all citizens of Allegany county, and duly reg-
istered and legal and qualified voters in Allegany county,
some of them in Election District No. 1, and the others in
Election District No. 10, of said county, and entitled to vote
for Senator at the election held in said county on the 6th day
of November, 1866, and that said witnesses attended the elec-
tion on said day, and that each and every of them, then and
there, tendered and offered tickets or ballots to the Judges of
said election in the election district in which they resided and
in which they were duly registered as voters; and that on
said tickets or ballots so offered and tendered to the said
Judges, the name of Alfred Spates was printed "For State
Senator," and that said witnesses severally demanded of the
Judges that said ballots or tickets should be deposited in the
ballot box, and that the said Judges refused to receive the
same.

And you are further notified, as aforesaid, that at the- same
time and place as aforesaid, there will be an examination of
the following.witnesses, viz :

Charles Best, Joseph Kenep, Peter Kenep, John Kenep,
William Arnold and William H. Kitzmiller. By these last
mentioned witnesses Alfred Spates expects to prove that you,
Charles H. Ohr, was a candidate for State Senator at the
election held in Allegany county on the 6th day of November,
1866, and that shortly prior to said day of election you, the
