Q. Why were you not there with your company?
A. I refused to do duty on the Western Shore with all of
the company except about 18: I was marched as a prisoner
to Stewart's Hill; drew new guns, the whole regiment; I
refused to take mine, and I told Capt. Long I wasn't going
to fight on the Western Shore; said I had sworn in to do
duty; only on Eastern Shore.; he said he'd show me; well,
said I, I considered myself under arrest, and if you don't
put me under arrest, I must follow the regiment; I went as
far as Taneytown, within 11 miles of Gettysburg, where I
gave out.
Q. At what time was your regiment mustered out of ser-
vice ?
A. Don't know.
Q,. Were or not you discharged previously to the expira-
tion of the term of which the regiment was enlisted ?
A. Yes, sir; 28 were discharged with me, almost all the
non-commissioned officers.
d. What was the cause of your discharge ?
A. Refusing to do duty on Western Shore.
Q. Was or not a Captain in your regiment discharged,
who afterwards entered the rebel army ?
A. I don't know what army he went into after he was dis-
charged; I suppose you mean Capt. J. C. Henry.
Q. In your examination in chief you stated that you were
informed a week or more before election, that your name was
not on the list of qualified voters. Why did you not at that
time enquire into the cause of your rejection ?
A. It was on Saturday, and could not see the list; the
next Monday I went to my work and didn't come back to
town until Saturday before the election.
Q. Where did you find the list ?
A. In Joshua Johnson's store; this list, they said, wasn't
right, and I thought I was registered until the election day
when I went to vote.

Q. Was your discharge an honorable discharge or not?
A. It was; I was paid off and got my bounty.
