141 The above has been. read to me and is correct. ELIJAH FREENY. Attested to and written by Henry Page, Clerk. Lewin J. Pollitt, a witness produced on behalf of claim- ant being duly sworn, answers and says: To the first. A. Fifty-one years; been a voter thirty years; resided in 1865, in district No. 2. A. Some half dozen . Benjamin Truitt, Nelson Crawford, William Smith and others, together with myself, applied at the same time; it was some time between two and three o'clock in the evening; they were about breaking up for the day; the Registers took down our names, and William Smith offered to take the oath, the Registers replied that their hour was out, to come in some other day and he would administer the oath. It so happened that two or three of us met at the same place and for the purpose of taking the oath; Smith, Crawford and Truitt, went up to demand the oath but were refused, and they being refused, I did not apply again; I was present waiting to do it, and was only prevented from applying, because they were refused. 3d. A. Did not vote; would have voted for Franklin. 4th. Waived. Cress-Examination: Was or not the William Smith mentioned in your exami- nation in chief registered as a qualified voter? A. I don't know. At what time did you make your first application to the registers ? A. I don't know precisely, but I think they had had two or three meetings. At what time did you make your second application ? A. I think on the last day of their sitting. |
