That I did not vote because I wasn't registered; did did offer to vote, and claimed my right as a freeman to cast it, and it was rejected because I wasn't registered; should have voted for Mr. Franklin . 4th. A. That I did not. see the registers conversing with the party that I supposed they intended to use, but I did see James Sims and heard him conversing with James Morris, and he asked James Morris if he did not vote with us at the last election, said he, fact I did; said Sims, Jimmy you can be admitted certainly, you apply they then parted, James Sims; then entered the door and I don't know whether he called the officer of registration or whether the officer came towards him , I saw from the first remark of Mr. Sims to the officer, that he was not exactly pleased. With a little further talk, he seemed to be satisfied, and to the host of my hearing, he says, well, well, either the old man is all right, or I suppose he is all right. (Contestant objects to all these conversations and statements.) Cross examination : Question. Did you read over the oath which, you were to take on your application for registration ? Answer. I did. Q. After reading the oath, did you not say you could not .conscientiously take the oath? A. I did not say so. Q. Of your own knowledge do you know any cause why .said James Morris of whom you have spoken in your direct examination should not have been registered as a qualified voter ?
