10 [EXHIBIT A. T. A. S.] STATE OF MARYLAND, Somerset County, to wit: To THE HON. JOHN B. FRANKLIN: WHEREAS, The Hon. Themes A. Spence has applied to me, as a Justice of the Peace of the said State, in and for the county aforesaid, to take testimony of witnesses to he pro- duced by him, before me, as such Justice, to testify in the matter of the contest between him, the said Thomas A. Spence, contestant, and yourself, of your election as Circuit Judge of the Twelfth Judicial Circuit of Maryland., at an election held on the seventh day of November, 1865 : I here- by notify you and require you to attend in person or by at- torney, in the fifth election district in Somerset county, at Princess Anne, at my office, on Wednesday and Thursday, the twenty-fourth and 'twenty-fifth days of January, 1865, at ten o'clock A. M., and crosa-ex inline witnesses whoso names are hereto annexed, to be produced before me by the said Thomas A Spence, in relation to the facts herein stated, to wit: Clement J. Gravenor, Francis A. Maddux, David Tyler, William Evans of John, Hainey Bradshaw, Jacob White, Matthias Disharoon, Purnell Johnson, Had- son Mills, Elihu J. Pusey, Rider W. Wilson, Richard S. Bounds, John. C. Cruckett, James E. Connelly, Major A. Robinson, Robert M. Elsey, Jonathan, Riggin, John Dix, Elsey Evans. Nicholas Jones, John J. Lawson, Thomas S. Dougherty, C. V. Simonson, John , S. Wilson, John.
