THE STATE of MARYLAND, Somerset County, to wit:
TO THE HON. THOMAS A. SPENCE.
WHEREAS, the Hon J. R. Franklin has applied to me as a
Justice of the Peace of the said State, in and for the county
aforesaid, to take the testimony of witnesses to be produced by
him before me as such Justice, to testily in the matter of
your contest of his election as Circuit Judge of the Twelfth
Judicial Circuit of Maryland, at an election hold on the
seventh of November, 1865, I hereby notify yon and require
you to attend in person or by attorney in the fifth eleton
district in Somerset county, at Princess Anne, at my office, on
Thursday the eleventh day of January, 18'; G, at 11 o'clock,.
A. M., and cross-examine witnesses whose names are hereunto.
annexed, to be produced before me by the said John K..
Franklin, in relation to the facts herein stated, to wit:,
George H. Richardson, Ephraim K. Wilson. Dr. George M..
(Upshur, George W. Covington, William Brattan and John:
W. Crisfield, to prove the eligibility of' the said .John R..
Franklin to the office of Circuit Judge of the Twelfth Judi-
cial Circuit of Maryland, and also to prove the illegality of
his rejection by the officers of Registration of the Snow Hill
Election District in Worcester county, as a legal and quali-
fied voter in said district
Given under my hand and seal this first day of
[SEAL] January, 1866.
