THE STATE or MARYLAND, Somerset County, to wit:
WHEREAS, the Hon. Jno. R. Franklin has applied to me
as a Justice of the Peace of the said State, in and for the
county aforesaid, to take the testimony of witnesses to be
produced before me by him, as such Justice, to testily in the
matter of your contest of his election as Circuit Judge of the
Twelfth Judicial Circuit of Maryland, .at an election held on
the seventh of November, 1865, I hereby.' notify you and re-
quire you to attend in person or by attorney in the Fifth
Election District in Somerset county, at my office, at Princess
Anne, on Tuesday the 23d of January, at 10 o'clock, A M.,
and on the 20th and 22d of January, at Roach's Store, in
District No. 14, Somerset county, at 10 o'clock, A M., and
cross-examine the additional witnesses whose names are here-
to annexed, to be produced before me by the said John R.
Franklin, in relation to the seventh point of the said John. R.
Franklin, mentioned in the notice served on the said Thomas
A. Spence, on the 30th of December, 1865, as to the illegal
conduct of the officers of Registration in the several election
districts of Somerset comity, to wit: Washington Insley, John
H. Stewart,' Asbury McGrath, James M. Dryden, John
Harris, George Dize, Manahaim Todd, Littleton J. Harris,
William Carens, W, R. Williams and James H. Haley, to
be examined at Princess Anne, on the l3d day of Janu-
ary, 1866; and the following witnesses to the same point to
he examined at Roach's Store, on the 20th and 22d of Janu-
ary, 1866, at 10 o'clock A. M'., to wit: David White, Wm. C.
Mason, William S. Moore, John Colbourne, James J. Moore,
Henry J. Johnson, John Hasey, John M. Johnson, Henry W.
Hall, Francis Ross, William D. Lankford, David Buntich,
