10th: June 1690 (88) Walter Lodge by complaint agt Michael: Williams and his Wife Patience that ye said Patience pr had taken some means out of a pott of the sd Lodges. to prove which came Martha Servant, hired to Recognizance the sd Williams and being upon her examination and Oath could prove nothing agt the sd Williams or his Wife, and thereupon the Court quasht the matter. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - pr Henry Smith Planter being accused for carrying a Bagg upon the Sabbath day. the Recognizance being Ditto Recog. given to the grand Jury Wm: Turvill foreman, brought in the Bill/ignoramus. - - - - - - John Cary. Enters his appearance being bound by Recognizance To the Worll. Comrs. of Somerset County Court, the humble Petion of Jane Cooper Relict of Samll: Cooper deceased humbly sheweth, That your Petioner, having obteined an Order from the honble Assembly that upon her application to this Court made should be admitted to have letters of Administration of the Estate of Samuell Cooper decd and to call into her hands all the books papers &c. of the sd decd now in the hands of George Layfield Esqr, in Order thereunto your Petioner hath demanded of the sd Layfield the sd papers, but the same hath C refused, your Petioner therefore humbly prayes your Worships to grant her letters of administration with an Order of this Court to the said Layfield to diliver the said papers to your petioner, and as in duty bound shall everpray By the Assembly Aprill 3d. 1690. Itt is the opinion of this house that Jane Cooper the Widdow and Relict of Samuel: Cooper late of Somersett County decd upon her application to the County Court may have Administration granted her of the Estate of her decd husband and by vertue thereof call into her hands the writings accots. and papers thereunto belonging. The former Lrs of Admrn hereto fore granted to Coll. Vincent Low. and by him Assigned to mr. George Layfield being surreptitiously and illegaly obtained and procured Signed pr order John: Llewellin Clk. The abovesde mrs. Jane Cooper haveing preferred the petion above, she now further supplicates the Worss.Court that the above sd letters of Administration required for her Selfe, may now be granted to mr. ffrancis:Jenkins, of this County. The said Jenkins proving in Court that the Estate of Samuel: Cooper was considerably indebted to him, as by two bills here inserted upon Record, and under the hand and seal of the sd decd Cooper doth appear. And there upon the Court having considered the matter, as also that the sd Jane doth and hath in Court revoked her Executrix togethers with all her right interest and title of any part or parcell of her deced. husbands Estate. doe Order that letters of Administration may be granted to mr. ffrancis. Jenkins of the totall Estate of Saumel: Cooper deceased. ----- And it is likewise Ordered that George: Layfield diliver all such papers and writings as in any wise doe pertaine to the sd deceased Samuel: Cooper to mr. ffrancis: Jenkins, who is now full and Sole Administrator of the sd decd Coopers Estate. Maryland Ss. Know all men by these presents that I Samuel: Cooper of Somerset County in the Province aforesd am holden and firmly bounden ffrancis: Jenkins of the County aforesd Gentl. in the full and just sum or quantity of Tenn thousand two hundred seventy eight pounds of good sound bright and large Merchantable tobacco in Caske to be paid upon demand at some One Convenient Towne in the County aforesd it being for a valuable consideration in hand allready recd, to the true performance whereof I bind my selfe my heirs Executors and Admrs. firmly by these presents, to the sd ffrancis his Heirs Executors, Admrs or lawfull Attorney, in the penalty of Twenty thousand five hundred fifty six pounds of like tobacco in wittness whereof I have hereunto Sett my hand and Seal this first day of December Anno Dom. 1685.
