March 15th 1689/90 (72) In fear and agt the publick Peace, Contrary to the status in that Case made and privided. Now= their Maties Attorney Craves judgmt may be entered agt the sd William: Morris Thomas: Quillain Samuel: Morris and Eliz: Morris according to Law. &c. James: Sangster. Clk Indt. Griffin Thomas Evidences Sworn. Martha: Aldrige The Jury being retourned brings in this following verdict viz/ Wee the Jurors do ffind William: Morris and Thomas: Quillain &c. , not guilty of a Ryot William. Piper. foreman. John: Starrett Plt. Declacon Read. And by mutuall Consent agt for tryall, by their Attorneys Dent, and Taylor Benjamin: Keizer. Deft. have put themselves upon the County. - - - - - Somerset County Ssc. Benjamin Keizer late of Somerset County Cordweiner was attached to answer unto John Starrett of a plea of trespass upon the Case. And whereupon the sd John by Peter Dent his Attorney complaineth that whereas the sd Benjamine the 25th. day of October in the yeare of our Lord 1689 at Manokin within the Jurisdiction of this Court was indebted to the sd John in six hundred and thirty pounds of Beef being for nine hundred foot of Inch Cypresse Plank, and the sd Benjamine to the sd John in manner aforesd being indebted the sd Benjamine in Consideration thereof did assume upon himselfe and to the said John then and their faithfully promise that he the sd Benjamine the said six hundred and thirty ~ pounds of Beef to the sd John when he should be there unto required would well and truly content and pay; nevertheless the said Benjamine by his promise and assumption aforesaid not regarding but minding and fraudulently intending the said John in this behalfe, Craftily and Subtilly to deceive and defraud the said Sum of=630 Pounds of Beef or any part thereof to the said John hath not paid although the sd Benjamine to doe the same by the sd John afterwards was requested but hath hitherto refused and doth still refuse to the damage of the sd John of 1600 pounds of tobacco, and thereof he brings his suite. Jno: Strawbridge George Bossman: Miles: Grey. William: Elgate: Simon Perkins Wm: Venables. Thomas Morris Rich: Warren. goes forth ----- And being retourned brings this following Verdict.
