mr. Edmund: Howard Plt (71} agt Declation Read. --- Issue joynd --- Referred to a Jury Henry Sadbury. Defend. Attorns. Dent pr plt. Taylor pr deft. And whereupon the sd Edmund by Peter Dent his Attorney saith that the sd Henry the 13th day of ffebruary in the year of our Lord 1688/9 at Pocomock wthin the Jurisdiction of this Court - bound him Selfe to the sd Edmund in the sd Sum of ten thousand pounds of tobacco for the performance of certain acticles and contracts, as by the sd articles here in in Court may appear and the sd Edmund sath that the sd Henry the sd articles and agreemts nor any of them hath not kept but the same hath broken, to the damage of the sd Edmund of 11000 Pounds of tobacco and thereupon brings his suit &c: Dent Pledges &c. Jno. Doe The Decln. being Read, and Evidences Sworne viz Peter Dent Rich: Roe and Benjamin: Keizer - - - - - - - - - - - - - - The Jury having heard the whole proceedings, being duely impannelled and Sworne, whose names are hereafter inserted viz: Wm: Piper: Sam: Collins. Mearcy.: ffountain. Thomas Rolph. Tho. Tull John: Strawbridge. George: Bossman. Miles Grey. Wm. Elgate. Simon: Perkins. William. Venables Thomas: Morris. goes forth. ---- And upon their retourn brings this following verdict. viz. The Jury finds no Cause of action aft the defendant William: Piper. foreman Their Majesties The Indictmt. being Read. But the sd Eliz: and Samuel: Morris agt not appearing. the sd William: Morris by Recognizance taken of Wm. Morris: Thom: Quillain 10000 pounds of tobacco became bound then to Court, to stand to what Eliz: Morris &. Sam: Morris judgmt. should be awarded by Court or Country agt the sd Eliz. or Saml. And there upon the said William Morris and Thomas: Quillain at the Barr for their tryall putts them selves upon the Country (viz) the Jury whose names are as followeth. Wm: Piper Samuel: Collins. Mearcy: ffountain. Thomas: Rolph: Tull. John: Strawbridge. George: Bossman Miles: Grey Wm: Elgate. Simon Perkins. William: Venables. Thomas: Morris. who being duely Sworne upon the holy Evangelists, having heard the Evidences and this following declaration Read goes forth. Somersett County Ssc. Wm: Morris of this County Planter, Thomas: Quillain & Samuel: Morris & Elizabeth Morris, daughter to the sd William Morris, were attached to answer unto their Maties wherefore their Maties attorney, comes and sayes that upon the second tuesday in November last past these persons above Named viz Wm: Morris Thomas: Quillain. Samll: Morris & Eliza. Morris, did unlawfully Assemble & convein at the plantation of Richard: Aldridge and violently by force and Arms did enter therein where then and their they did threaten to burn the sd Richard Aldridges house together wth his Wife and the ffence did break down, and wth instruments to the purpose brougt did digg up the number of fifty aple trees by their Roots whereof the greater part were bearing trees planted in an Orchard and then did violently by force and arms Carry away, with Severall other Ryotts and Outrages done putting their Maties good people in |
