(73) Samuell Sandford Plt Declaration Read Referred by Consent to ye Court agt William: Piper Deft. Attor: Sangster for Sandford: & Dent for Piper - - - - - - Somerset County Ssc. William Piper of this County was Sumoned to answer unto mr Samuel Sanford of the County of Accamack in the Collony of Virginia Mercht in a plea of trespass upon the Case And Whereupon the plt. by James Sangster his Attorney Comes and sayes that the sd William Piper defendt. is become and stands indebted unto the plt. in the Sum of two hundred pounds of tobacco it being for certain nails and spikes which the sd defendt. did take out of a bagg of nails then in the Custody of the sd defendt without the knowledge or consent of the plt. and for which the sd defdt. did afterwards assume to pay and make satisfaction, But he not withstanding of ye sd assumption and promise fraudulently and Craftily intending to deceive the plt hath denyed to pay and yet doth deny though often thereunto required, the plt Sayes he is damnifyed and hath loss to the value of four hundred pounds of like tobacco; and hereupon brings this suite. Sangster pr Quer. Pled de prsois John: Doe Rich. Roe Then was this following accompt produced Capt. William: Piper Dr. Tob: 1683. To 2in : 4d nales you acknowledged to have taken out of my bagg of nails Came in yr vessell --ley. and 10n pound of spikes by Benjamine: Wadloe all which you promised paymt for in all two hundred pounds of tob: ---- 200 Samuel: Sandford. Then was this accot. produced and Sworne to in Open Court by Capt William: Piper Mr. Samuel: Sandford Dr Anno. 83. To ffreight of a Bagg of Nails 5s: William: Piper The Court having Considered both accompts it being referred to their Worshps. do find the matter. No cause of action agt Piper - - - - - - - - - - - - - - - And whereas John: Webb was Sumoned to this Court to answer to their Maties. and the sd Webb appearing, but no Evidences agt him, thereupon his cause continued till next Court, and then no Evidence appearing the sd Webb by Order of Court to be released. - - - - - - - - - John Lowder Plt. The defendt being called 3 times but not appearing. the Court agt then Ordered his Bail Bond to be Assigned over to the Plt or Walter: Lodge Deft. to his Attorney which was then performed. Bond qt. 6844lb tob. Memorand/ there was no declaration then. But in June Court Dent shuffled it in amongst the Declens. contrary to law./ Vide folio 130/ Recordary Decln3 |
