(69) To all Xtian People before whom these prsents shall come greeting Wee Claybourn Haslewood and Abraham Knott Marryners Send greeting &c. Whereas wee the persons before mentioned have matters of difference & Contreversies depending between us the which of our Selves we cannot end or conclude to each others content & Satisfaction, Now know ye that we the persons before named have each of us chosen and elected, Wm: Round, Tho: Purnell, Jno: Townsend and Samuel: Hopkins, Arbitrators indiffenently between us the persons aforesd, to hear Arbitrate and judge of the sd Controversies relating to wages and Clothes Claimed by the sd Abraham of and from him the said Haslewood, and to the sd Arbitraters, and their Arbitrement Wee the sd parties, doe by these presents wholly -ferr our Selves obliging and binding our selves, Executers and Admrs to each other in the penall Sum of Six thousand pounds of tobacco to stand unto and abide the Arbitramt. finall Award and judgment of the said Arbitrators. In Wittness whereof we the sd persons in Controversies as aforesd have hereunto put our hands and Seals this 9th. day of June 168 Abraham: Knott. ? Clayborne Haslewood ? seal his mark. testes. To all Christian People before whom this present writing of Award shall Come, Wee William Round Thomas: Purnall John Townsend and Samuel: Hopkins, Arbitrators Indifferently Chosen & elected by Abraham Knot and Claybourn: Haslewood, Marryners, to Arbitrate, Judge determine & finally to end Such differences and Controversies as hath been had moving and depending Between the sd parties Relating to wages and clothes due to the sd Abraham. Now Know ye that we the sd Arbitrators having deliberately heard the Alligations of the parties in Controversies aforesd and having debated weighed and Considered thereof the same. Wee doe Arbitrate, Judge and Award as followeth. to witt that the said mr. Haslewood shall pay or cause to be paid, unto the sd Abraham. his wages and his Clothes according to to bargain and agreement made in Barbados for the whole time of his the sd Abrahams service with the the said Haslewood, untill the time of the sd Abrahams dissobedience and neglecting or sleighting his imployment, we finding that the sd mr Haslewood tooke no due Course according to the Laws of this Lord--- Province to correct the sd Abrahams Misdemeanours and quallifie him for future Service in his voyage back to Barbados Also wee the sd Arbitrators, deem, determine and judge that the sd Haslewood and Abraham doe beare and pay their just moyeties and equall proportions of their Cost and Charge of this Arbitrement the premisses is the finall Award of us the Arbitrators aforesd as Wittness our hands and seals this 9th. day of June 1688. - - - - - - - - - - - - - - signum William: Round ? The premisses being Considered, and mr Matthew Scarbrough then in Court, who was spetiall bail for Haslewood. the Court demanded, if he the sd Scarbrough were willing to stand to whaC should then be determined, the said Scarbrough was very willing and thereto Assented Whereupon the Court referrs the matter to the Jury, then duely impannelled and sworne viz William: Piper. Samuel: Collins. Mearcy ffountain Tho: Rolph. Tho: Tull. Jno Strawbridge George Bossman. Myles Grey: Wm. Elgate. Simon: Perkins. Wm. Venables: Tho: Morris. who having thorowly understood understood the whole proceedings. and goes forth to determine ye affaire Who to say the truth of the matter doe bring in this following verdict --- Wee The Jurors find that mr Haslewood pay unto Abraham Knott the full share of his amount proved in Court William: Piper foreman. - - - - - - - - - - Abraham Knot engages to Court not to take out Execution till August then Ordr to Issue against the Bail Bond for 10,: 17s. 6d & 150lb tobacco being the full accot sued for. |
