March 13th 1689/90 Peter Whaples. plt. (62) agt Thomas Willis deft} Somerset County Ssc. Thomas Willis late of this County was attached to answer unto Peter Whaples in an accon of defamation &c. - - - - - And whereupon the plt by his Attorney Thomas Pool comes and saith that the the said Thomas in the month of November last past at the house of Donack Dennis in Nusswadox in the markett place where the plt was dealing with the Mercht f for such necessaries as his family was in great (want) of The defendant Thomas Willis came in and grosly abused the plt calling him Rogue for Sworne Rogue and said he would prove him so in Court, whereupon the plt saith he hath damage in his Credit rputation and good name and estate to the value of tenn thousand pounds of Tobacco and thereupon brings his Sute. Pledgr Deprs John. Doe prQuer Thomas Poole. Rich Roe. Not guilty upon the Country and ye Plt also. Dent pr deft. Poole - - - - - - - - - - - - - - - Both partyes by mutuall Consent puts themselves upon the Jury whose names, as followeth William Piper Samuel: Collins. Thomas: Morris. all being duely impannelled and Sworne goes forth having heard the whole matter C and to say the trueth doe bring in their verdict as followeth. Wee the Jurors find that that Thomas Willis deft pay unto Peter: Whaples plt four hundred pounds of tobacco with Cost of suite. William Piper. Order the verdict to be entered To the Worll. Comrs of Somerset County now Sitting The humble Peticon of Edward Wale and John: Boden. humbly sheweth that your petioners being come from afarr and living at a great distance ar Sumoned as wittnesses in a plea of trespass dependg between Thomas ffenwick plt and William ffosset deft. Wee your petitioners humbly request your Worships that our Affidavit may be taken, your petioner being here strangers, and we with our horses - Strait ned here we humbly begg your Worships consideration of our condition and yr peticonrs shall ever pray This petion Read in Court but not assented to Mr Round. Ss/ March 9th 1689/90 I humbly request the favour of you to enforme the Court of my Wifes condition that she is now in (viz) to the best of my judgmt. she is not long for this life, she is in a dangerous & desparate condition and all her head and face, seems as if it were perishing, all swold up and perish as it swells, with severall other daingerous Symtoms attends her Bro: Poynter and his Wife hath been this day to visit her, they doe look upon her to be past hopes of recovery. John Barron hath likewise seen and can informe you of her condition its too real truethl If in Case she lives I stand still bound for her and Sisters appearance next Court your Servant John: Vigorous. C The letter being Read Vigorous was excused for yt time To their Maties Justices of the peace for Somerset County -------- the humble Petion of Nynoon Dunlap humbly sheweth to your Worships that the petioner was lately presented as he is informed, but knows not by whom or for what and hath attended the Court Since Monday last, Now so it is that the petioner being removing up to the sea side and will be at great loss by attending Court so long may it therefore please your Worships to cause the sd presentmt. be brought to tryall, that the petioner may be discharged and the petioner as bound in duty shall pray &c. Damol: Dunnahoe made Oath that he had attended five dayes at Court, being Sumoned both by Peter Whaples and Thomas: Willis. Order for the same |
