(63) To the Worshipfull Court of Somerset County your Petioner humbly sheweth that he hath attended this he nor- Court to answer to a vexatious Sute Comenced by Richard Murrow, now himselfe absconded from Law your Petioner humbly Craves that his appearance may be entered and your petioner shall pray &c Tho: Morris = Court adjourns till 9 a clock next day. March the 14th. Anno Domini 1689/90. Comissioners Present. Capt. David Browne. mr. ffrancis Jenkins Capt Robt; King. mr. James Round mr Samuel: Hopkins. mr mr. Edmund: Howard mr Thomas Jones ----- The deposition of John: Webb aged 33 years of thereabouts Sayeth that mr Thomas Morris and ye Defent accounted and there was due to the best of my memory to your Deponant 362lb. of tobacco Richard: Murrah being then present, your Deponant oweing the sd Murrah the like value, discharged the said Morris for the above sd Sum of 362lb. of tobacco and further sayeth not - - - - - - - - - - - - - - - - - - This Deposition sworn to in Open Court pr John Webb and allowed on by Thom: Morris Thomas Pool. Plt agt Declarition Read. Issue joynd. James Barry Deft Somerset County Ssc. James Barry Tanner late of this County was attached to answer unto Thomas Pool. in a plea of trespass on the Case. &c. And whereupon the plt for him selfe saith that he the said James in the year of our Lord 1689 became indebted unto the plt the full and just sum of five hundred pounds of tobacco and one pair of womans shoos as will in Court more plainly appear as per accot. here in Court produced, but he the said James fraudulently intending the plt to deceive of the sum aforesd and shoos - doth deny to pay the same although often thereunto required by the plt whereupon the plt saith he is damnifyed, and hath to the value of One thousand pounds of tobacco and thereupon brings this suit. John: Doe Rich: Roe And the sd James Barry by his Attorney Edward Jones Comes and defends the force and injury &c and when &c. and saith that the plt his action ought not to have, but saith that the defendt is no wayes indebted unto the plt and thereupon puts himselfe upon the Court The defendt.
