61. William: Willmott Plt. agt. Declaration Read John: Rowell Deft. Somerset County Ssc: John. Rowell late of this County Cordwainer was Attached to answer unto Wm: Willmott mercht. of a plea of trespass upon the Case &c. ---------------- And whereupon the said William by Peter Dent his Attorney Complains that whereas the sd John the 30yh. day of July in the year of our Lord 1689 at Rehobeth within the Jurisdiction of this Court was indebted to the said William the sum of thirteen bushels of good sound merchantable Wheat, being for divers goods & merchandizes before that time Sold and delivered as by a perticular accompt thereof here in Court ready to be produced more fully and at large appeareth, and the sd John to the sd William in manner aforesd being indebted, the sd John in Consideration thereof did assume upon himselfe and to the sd William then and there faith fully promise that he the sd John, the said thirteen bushels of wheat to the sd William when he should be thereunto requested would well and truly content and pay Nevertheless theless the sd John his promise and assumption asd not regarding but minding and fraudulently intending the said Wm in this behalfe Craftily and subtilly to deceive and defraud Seven bushells part of the said thirteen bushels of wheat to the sd William hath not paid, although the sd John to doe the same by the said William afterwards was requested but hath hitherto refused and doth still refuse to the damage to the damage of the sd William of 800lb. of tobacco. and thereof he bringeth his Suite Dent: prQuer Pledgd. John: Doe Judgmt. Confessed for Rich: Roe Seven bushels of Wheat order for the same Somerset County Ss. William Aylward late of Somerset County was Attached to answer unto --- Arnold Elzey of a plea of trespass upon the Case ------------- And whereupon the sd Arnold by Peter Dent his Attorney saith that the Sd William the 12th day of Janry in the year of our Lord 1689. at Monokin within the Jurisdiction of this Court was indebted unto the sd Arnold in the sum of One thousand pounds of tobacco, being the ballance of accot. due to him the sd Arnold for one horse to the sd William Sold and delivered, and the sd William to the sd Arnold in manner asd being indebted did assume upon him selfe and to the sd Arnold faithfully promise the sd Sum of one thousand pounds of tobacco when requested would content and pay. Nevertheless the sd William the sd sum of 1000lb of tobacco to the sd Arnold hath not paid to the damage of the sd Arnold of 1600lb of tobacco and thereupon he brings his Suite &c. Dent. Pledgr. John: Doe Rich Roe. } - - - - - - March the 12th 1689/90 Arnold Elzey made Oath that he hath recd no more than the sum of Eigteen hundred pounds of tobacco part of two thousand eight hundred pounds of tobacco and that there is justly due the Sum of One thousand pounds of tobacco from sd Aylward Sworne before us Robert King This should have been entred folio 52 Edmund Howard Where attachment is Ordered |
