(60) Somerset County Maryland. To the Worll. Justices of their Maties Peace for this County of Somerset now sitting the Petion of William. Alexander Senior and Junior. humbley sheweth. - - - - - - - - - - - - - - That Whereas your humble Petioners hath remained both here to give our depositions as evidC for their Maties. agt Henry: Hayman. wee your Petioners earnestly beggs that our depositions may be taken, for your Petioners being so long here absent from our Katle we know not but wee may Suffour great damage by loss of our Cows and other Creatures, therefore your petioners begg your Somerset Worships Consideration of our Case. and your petioner as duty is shall ever pray. &c. County} Maryland Know all men by these presents that I John Parsons of the County and Province aforesd doe bind myself unto their Maties. in the sum of ten pounds Sterling. good lawfull money of England to prosecute Henry Hayman in their Maties Suite at the next Court held for Somerset County, given under my hand this 12th day of December in the year of our Lord One thousand Six hundred Eighty and nine. That this day 12th of December in the first year of King William and Queen Mary Over England Scotland ffrance and Ireland defenders of the faith &c. Henry Hayman of Wiccocomocoe in the County aforesaid Cooper made his personall appearance before me John: Winder Gent One of their Maties Justices of Peace for the County abovesd and did acknowledge himselfe to be indebted unto their Maties the Sum of ten pound of good lawfull money and Robert Crouch and Sampson Power of Wiccomocoe in the County aforesd and did acknowledg them Selves to stand indebted to their Maties. in the Sum of five pound a peece of the like lawfull money of England which sd severall sums they and every of them doe acknowledge to owe and stand indebted to their Maties to be levyed upon their Land and tenamts &c. The Condition of this above written Recognizance is such that if the bound Henry Hayman doth personally appear before our Maties Justices of the Peace at the next Court held for the County of Somerset abovesd and then and their to answer unto Such matters as shall be objected agt him on the behalfe of their Maties. by John: Parsons, and further doe stand to & abide to Such judgments. as shall be given by the Justices then sitting then Recognizance to be voyd and of none effect, or otherwayes to remain. & abide in full force and vertue John Winder Robert Crouch. ? seal Thomas: Walker Sampn. Power. ? seal The Jury being Retourned Whose verdict is as followeth ---- Wee the Jurors find Henry: Hayman guilty of tolling up hoggs in the woods which were not his Owne and Shooting at them ~ William Piper. foreman. - - - - - The Court Orders the said Henry: Hayman to give Security for his good behaviour and appearance every Court dureing the Courts pleasure, as also for Court Charges. An thereupon Came John Goldsmith and William Goldsmith and by Recognizance owned to be justly indebted to their Maties the sum of five pound Sterling money to be leavyed on their goods Chattels and tennements and the sd Hayman in ten pounds of the like money aforesd. The Condition of wch Recognizance is Such that if the above bound Henry Hayman be of the good behaviour to all their Maties Liege people of this Province dureing the Courts pleasure. as also that he pay Court Charges that then this Recognizance to be voyd and of none efect other wayes to be and remain in full power force and vertue. March 13th (60) (A/ see forward for folio 61 also) 1689/90 Comissioners Present as afore in folio 56. - - - - - - - - - - - - - - - - - - To the Justices of the Peace for Somerset County now Sitting in Court - - - - - - - - - The humble Petion of Donan Loumann James Smith & others Humbly Sheweth to your Worships that lately Thomas Tyar and John: Bennet hath turned the County path Leading from. mr. ffurnisses lower Plantation to Nusswaddock Bridge lately Inhabited by George Clandenning, and filld up the said path with Corne ffeilds and fallon trees Soe that noe passage is for persons about their Lawfull Occasions. May it therefore please your Worshipps to Order it soe as said Tyer and Bennet may forthwith cleare sd path and your Petioners shall pray. Which Petition was was immediately Granted To the Worll. their Maties Justices of the Peace for Somerset County the humble Petion of Samuell Horsey Sheweth that whereas your Petioner hath a Servant Woman by name Ann Butler which hath had a Basterd Child. in your Petioners time of her Service, soe that your Petitioner humbly Craves your Worps. order for the lost time besides the nursing of the Child One year and halfe, which your Petioner Craves your Worships order against the sd Ann: Butler and your Petioner as in duty bound shall ever pray &c. - - - - - - - - - - - - - The abovesd Petion being Read. the Court Orders that the sd Ann. Butler pay unto Samuel: Horsey Six hundred pounds of tobacco for her Childs nursing and likewise Six hundred more for Child diet and accomodations till June, as also Order that the sd Ann give the sd Samuel good Security for the payment of twelve hundred pounds. Tobacco - - - - - - - - - - - - - - - - - - Somerset County in Maryland To ther Worshipfull Justices of the Peace for this County of Somerset the Petion of Samuel: Showall humbly sheweth that whereas their was an Order. of Court granted for the Removall of Elizabeth Smith from Doctor John: Vigerous, the humble desire of your Petioner is, that the said Order may be put to Execution. Or if your Worships see it fitt your Petioner is willing to take Care for her education your humble Petioner Craves your Worships judgment therein and your Petitioner as duty full shall ever pray &c. The Petition being Read and Considered. The Court Orders that the sd John Vigerous doe deliver Elizabeth: Smith with all her goods in Spoties to Samuel: Showell and like wise Order that Samuel. Showell give Security that he shall performe in all things as in petition and for the advantage of the said Elizabeth Smith. - - - - - - To the Worll their Maties Justices of the Peace for ye County of Somerset the humble Petion of John: ffranklin humbly sheweth that in Janry Court Henry Lynch did petition for the sum of four hundred thirty seven pounds of tobacco, and obteined an Order agt the Estate of John: Cropper late of this County deceased, wch said Order was entered your petioner being present, and your Worships did Surprise, affirming that the sd accompt that the said amount was part of pay for a servant he bought of Capt. Hased?,when the very accot. doth show that it was for Rum and Suger. Your Petioner likewise sayes, that he did affirme ye petioners Wife would own the accompt that it was for pork when your peteioner can Evidence the denyall of it to mr Lynch, before your petitioners craves your worships to consider the premisses that your Worships may not be Surprised or your petioner pay pork for tobacco and shall every pray. The Court requires ffranklin and Lynch to end the matter |
