(54) Their. Majesties . . . The Indictment Read agt Matthew Scarbrough To which Matthew Scarbrough plead not guilty Somerset County Ssc. The Jurors for their Maties. being Sworne upon the holy Evangelist at a Grand Jury held for the body of this County the second tuesday in March 1689/90 doe present and find that mr Matthew Scarbrough of this County Gentm. upon the 7th day of Janry last past was at the house of John: Webb of this County Innholder attached in their Maties. Names to answer the suites of Stephen Tage then legally Issued agt the said Scarbrough, but the sd deft did then and their deny any power Roger Burkham Sworne Sub sheriffe had to arrest him and that there was no more Justices of the Peace in this County then he was and refused to give bail Therefore their Maties Attorney comes and sayes that the sd Matthew Scarbrough hath not only refused to Obey the power and authority of this government but by his practice and behaviour given occasion to the people of this Province to contemne all authority in ye future and Craves judgment may be entered agt the Offender according to Law. James: Sangster. Clk. Indt. Their Maties Evidences likewise Sworne viz John: Webb: Thomas: Oxford Roger Burkham. - - - - The above said Indictmt. being read and the (E)vidences Sworne the said Matthew Scarbrough desires to be tryed by a Jury which Jury appears being impannelled and Sworne whose names are followeth viz William: Piper. Samuel. Collins. Mearcy: ffountain. Thomas: Rolph. Thomas: Tull. John: Strawbridge. George:Bossman. Myles: Grey. Thomas: Hollbrook. William Harris. William: Alexander. William : Round. who goes forth to consult the matter. and being retourned brings in this following verdict. viz. Wee the Jurors find Matthew: Scarbrough guilty for Contempt of the present power or Authority. William: Piper fforeman. - - - - The Verdict being read before the said Scarbrough, who seems to be very Penitent and heartily Sory, for which he humbly beggs pardon - - - And there upon the Court Orders him to give Security. Whereupon Came the said Scarbrough and George Bossman and by Recognizance became bound to their Maties. Scarbrough in ten pounds and Bossman in five pounds --- The Condition of which Recognizance is Such that if the said Scarbrough be of the good behaviour and abearance to all their Maties Liege people of this Province that then this Obligation to be voyd and of none effect, Otherwayes to be and remain in full power force and vertue. James Ingram By Recognizance engages to the Court to have his Wife there before the Justices, to answer what shall be objected against her. - - - - - - - - - - - Somerset County. - - - - - To the Worll. Commissioners of Somerset County the Petion of. - - - - - ` Henry Morgan humbly sheweth that whereas your Worships Petioner was Summoned to appear this Court before your Worships, these are humbly to informe you that I have received a great injury by an accident in one of my leggs in so much that I am no wayes capable to waite on your Worships. according to my Summons therefore hope yr Worships will be pleased to have a favourable construction of your Petitioner for his non appearance and your Petioner as in duty bound shall pray.
