(53) The Indictmt. being Read to wch the sd: Carey pleads not guilty and for his tryall put him Selfe upon the Jury, which Jury is as followeth viz William Piper foreman, Samuell Collins, Mearcy ffountain Thomas Rolph. Thomas: Tull. John: Strawbridge. George Bosman Miles: Grey Thomas: Holbrook. William Harris. William: Alexander. William Round. who to say the truth being sumoned, Impannelled and sworne upon their Oaths say Wee the Jurors find John: Carey guilty of the Indictment William: Piper foreman. - - - which verdict was ordered to be entered. - - - - - - - - - - - - - - The Court having Considered the premises doe order that John Carey doe pay fifty dayes worke and dyet for the Courts use when demanded as also find good Security for the same and for his good behaviour and Court Charges. And thereupon came came Owen Megraugh and Charles Mullen and did by Recognizance wth ye said Carey acknowledge themselves to be indebted to their Majesties in 10, sterling a man and Carey in 20, sterl. The Condition of which Recognizance is such that if the above bound John: Carey doe well and truly pay fifty dayes work and dyet when demanded as also be of the good behaviour to all their Maties Liege people of this province and that he pay Court Charges that then this Recognizance to be voyd otherwayes to remain in full power force & vertue. Somerset County Emanuel nigro Slave to Coll. William Coulborne late of this County was- attached to answer unto what should be objected agt him on behalfe of their Maties. ~ ~ And whereas the sd Emanuel Stands indicted in that he hath most wickedly sinfully and shamefully Committed fornication with An: Butler Woman Servant to Samll. Horsey and upon her body hath begotten a Basterd Child to the great dishonour of Allmighty God, Scandall and evill example to all the good people of this Province and agt the good Laws and Institutions of this Province and agt the good laws and Institutions thereof. Their Maties. Attorney Craves judgmt. may be entered agt the sid Nigro according to law in that Case made and previded. &c. James: Sangster Clk Indt. The said Emanuel pleads not guilty to Indt. But the sd An Butler at ye Barr makes Oath that the sd Emana ye Nigro is the only ffather of her Basterd Child: for which said fact he being of all thought guilty. is by the Court Ordered. that the Sheriffe take into Custody the said Nigro and at the whipping post to give him upon his bare back thirty nine lashes well laid on. And the sd An. Butler to stand by his side, all wch was performed. - - To the Worll. Comissioners of Somerset County, the humble Petion of Edward ffowler humbly she(weth) That the place where the fferry is now kept at Wiccocomocoe in this County is a very inconvenient place and the said Edward now liveth in a more convenient place where the ferry was formerly kept, your Petioner humbly prayes your Worships would be pleased to remove the sd fferry and grant the keeping of the sd fferry to your Petioner who will oblige him selfe to keep a good Boat and give due attendance and your Petioner as in duty bound shall pray &c. which Petion was granted, previded he give Security to a Magistrate, to performe his Petion This Security must be given before he take possession of ye fferry |
