Alexandr: Hillous Pet. Joyns Issue (51) Issue joynd Michaell: Holland Deft Maryland Ssc. The humble Petion of Alexander Hillous ---------- To the Worll. Their Maties Justices of the Peace for the County of Somersett most humbly Sheweth to your Worships that your Petioner hath a cause depending in Court which your Petioner thought to have had tryed last Court, but then their Maties - business being so much then their that your Petioners Cause was continued till now to the great loss of time and expenses besides the loss of good opportunity for his passage out of the Country, your Petioner having no other business att that time or now to hinder him, except the cause depending --- May it therefore please your Worships to consider of the premisses and to dispatch your petioners cause with suffient costs for loss of time and expenses and as in duty bound your Petioner shall ever pray Somerset County Ss. Michael: Holland of Somerset County was attached to answer unto Alexander: Hillous of a plea of trespass upon the Case &c. - - - - - - - - - - - And where upon the said Alexander by Peter Dent his Attorney Complaineth and saith that where as the said Michael the 12th day of November in the year of our Lord 1689. at Monokan wthin the Jurisdiction of this Court was indebted to the said Alexander in the sum of fifteen hundred pounds of porke as by a Certain note Subscribed with the proper hand and seal of him the said Michael here ready to be produced in Court more at large appeareth and the said Michael to the sd Alexander in manner aforesd being indebted. the said Michael in Consideration there of did assume upon him selfe and to the said Alexander then and their faithfully Promise / that he the said: Michael. the said Sum of fifteen hundred pounds of Porke to the sd Allexander when he should be thereunto requested would well and truly Content and pay, Nevertheless the sd Michael his promise and Assumption aforesd not regarding but minding & fraudulently/ intending the said Alexander in this behalfe Craftily and Subtilly to deceive and defraud the sd Sum of 1500 Pound of Porke or any part thereof to the said Alexander hath not paid although the said Michael to doe the same by the said Alexander afterwards the day and place aforesd was requested but hath hitherto refused and doth Still refuse to the damage of the sd Alexander of two thousand four hundred pounds of Porke and thereof he bringeth his Suite Dent Pleger John: Doe Rich: Roe Capt. Smith pay the 15 hundred weight of Porke to the Bearer Alexander Hillous or his order that is due to him for one of the servants, for he sent them in on his account and this note with his receit shall be your discharge. from your Servant to Comand November 12th day of 1689 . - - - - - - - - - Michael: Holland Dent Plt The premisses Considered the Court Orders Michael Holland to pay unto Sangster} Alexander: Hillous fifteen hundred pounds of Porke. - - - - - - - - Deft: and Cost of Suite Maryland Ssc. Received of Capt Henry Smith of Somerset County One Bond of Richard Wailes of Charles Town in New England for the sum of sixty four pounds and six shillings starling money of England for the well and true payment of thirty four pounds and Six shillings of the same money and doth promise to be accomptable for what moneys I shall receive of him the said Waile or Jarvis Ballerd for the use of the sd Smith first paying my selfe for a Cable: dilivered unto the said Smiths Order. as wittness my hand this 20th ffeby 1688/9 Miles Grey Samuel: Wilson Joseph: Thaxter The above receit should have endorsed in folio 50. as also 3 Evidences Sworne for the Plt viz Capt. Robert: King mr Randall Revell and mr Henry Lynch - - And the Court orders that sd Thaxter pay to ye sd Smith 7,. 4s. New England money & give Security for ( ? ) Smith or Order in New England with Smiths payment left als Execut(ion) |
