Joseph Thaxter was Sumoned to answer unto Capt Henry Smith in a plea of trespass upon the Case - - - - - And the said Henry by his Attorney Pet. Dent saith that the said Joseph in the years 1688/9 did undertake as the said Henry Attorney to receive of Richard: Waite, and Jarvis Ballard both of New England Severall Sums of money due unto the said Henry from the said Waite and Ballerd to the value of One hundred and Od pounds and did oblige him selfe for what moneys he- should receive for the said Henry to bring in and deliver the danger of the seas only accepted unto the said Henry one paire of Milstones and the remainer of the moneys to bring in as pr Order in August or September last to be dilivered at Monokin, but the said Joseph. fraudulently intending to deceive the said Henry hath not as he pretended brought in the said Milstones and other goods according to his promise but hath converted the said Henry=s money unto his own use whereby the sd Henry is damnifyed and hath damage One hundred and fifty pounds sterling money and thereupon he brings his suit.
