Their Maties The Indictment Read. viz. agt Somerset County Ss The Jurors for their Majesties Nyneon Delap being sworn upon the holy Evangelists att a Grand Jury held for the body of this County the second tuesday in March Last past doe present and find that Nyneon Delap of this County Taylor, in the year of our Lord one thousand six hundred eighty and five, did steal felloniously and cary away searg Cloth out of the house of Mary Carrol Widdow, Contrary to the sacred laws of Almighty God, the good laws and Institutions of this Province and against the publick peace. Therefore their Maties Attorney craves judgmt may be entered against the said Nyneon Delap according to law in that case made & provided James. Sangster Clk Indt Delap pleads not guilty to the abovesd Indiuctmt. wch Indt for Court adjourns till 9 aclock next day {wants of Evidence is Quasht. - - - - - - Nicolas Tyler appears before the Court was called and in the presense of Capt. Th.Jones Joseph: Thaxter Deft.} upon the Court To the Worll Court of Somersett County - - - - - The humble Petion of Joseph Thaxter Sheweth that your Petioner being arrested to this Court at the suit of Capt Henry Smith in two actions and your Petioner having a Vessell lying at great Charge in Accamack County and goods to dispose in Order to her loading and dispatch your Petioner doth humbly pray that the said actions may be called to the end he may be at liberty to look after his more weighty affairs, which shall be acknowledged as an act of favour to a stranger and he will pray Srs. Your humble Servant. Joseph:Thaxter Know all men by these presents that I Henry Smith of the County of Somerset and Province of Md: doth constitute and appoint my loving friend mr Joseph Thaxter my true and Lawfull Attorney for me and to my use to ask demand and receive all manner of debts dues or demands that is any way due unto me in the Government of New England, by Bill, bond, accot. or otherwayes and upon refusal or non payment to sue arrest implead or imprison any person or persons that is any wayes indeb =ted unto me, and upon occasion to employ one Attorney or more as he shall think convenient and necessary, and upon payment of any debt or debts to give releases and discharges as effectually as if I were there personally present ratifying and confirming what my said Attorney shall law= =fully doe in all things as I may or ought to doe as wittness my hand and seal this 14th.ffeb 1688/89 Benjamin Thaxter.
