To the Custom of the Country dureing the said term aforesd in Wittness whereof the said Master and Apprentice have to these Indentures, Interchangeably put their hands and Seales this tenth day of november 1685. his Edmund: Butler ? seal Being present mark Stephen Luffe. John:Winder - - - - - - - - - - - Robert: Crouch Tho: Morris. - - - - - - - - Assign over the Contents of the wthin mentioned Servt. named Edmund Butler for the terme and Space of Six years as within mentioned unto mr Edward Day his Heirs, Executrs Admrs or Assigns. as wittness my hand and Seal this 18th. day of April 1686 James:Baxter Memorandum that the said Edmund Butler produced an Indenture in Court he said he had of Jeffrey Stritch Mercht. for four years, but their was neither hand Seal or Wittness to the Indenture, nor could it be sufficiently proved, and Whereupon the said Butler and Day joyns Issue. by mutual Consent and refers the matter to the Jury aforesaid, who as aforesd being Sworne, and retourns their verdict which is ordered to be entered viz. Wee the Jurors doe find that the plentiffe ought to serve According to the Custom of the Country as if he had not Indenture. William Piper. - - - - - - - - - - John: Mealy Servant to Capt. David Browne acknowledges him Selfe in Open Court that the Assignmt. made Over to Capt Browne is just and due and that he ought to Serve according to the tenour there of which is the Courts opinion alsoe Charles Hall brings a Nigroe in Court viz Harry. who lately lived wth mr John: King - requiring judgment of their Worships what he might doe he having no Master as the Nigroe Sayes. the Court Orders the said Hall to keep the said nigro till further order Somerset County Ss James: Murrey Servant to mr Robert King was attached to answer to what should be objected agt him in behalfe of their Maties. - - - - - - - - - - - - And Whereupon the said James: Murrey Stands indicted in that he the sd Murrey hath most wickedly shamefully and sinfully Comitted fornication upon the body of Elizabeth: Greer of this County and begotten a Basterd Child to the great dishonor of Almighty God. Scandall and evill Example, of their Maties good people of this Province March Court and agt the statute in that Case made and provided, their Maties: Attorney Craves judgment 1689 may be entered agt the said Murrey according to Law. James: Sangster Clk Indt. 90 To wch Indtmt. the said Murrey at ye Barr pleads not guilty ----- But the said Elizabeth Greer made Oath then that he was the only ffather to her Basterd Child And thereupon the Court orders that the sd Murrey give Security for good behavior and to keep the County harmless from ye Bastard Child - - - - - - - - - - - (48:) Mr. Francis Jenkins made Oath in Open Court Concerning a Bond due to him from John Kirke which Bond was ordered to be signed Joseph ffreeman John: West Vide bond folio 140. with accot. Wm: Aylward Whereas by a due Course at Law Capt David Browne recovered an attachmt Deft. agt the goods Chattels and Creditts of William Aylward late of this County which attachment Issued into the sheriffs hand who proceeds as followeth \\\ of this within Maryland. John: Jackson at Wiccomoco in the County of Somerset a white horse branded with W. which said horse the said Jackson did declare to be the effects of William Aylward with in mentioned was attached upon the accompt of Capt. Mackbride, his Robert Crouch mark Attached upon the Plantation of Capt Henry Smith One man Servant Named Michael Lynch belonging to William Aylward I say attached the 3d. day of March 1689 pr. me Roger Burkham Sub sheriffe - - - - - - - - - - - - - - - 90 March the 7th 1689: The above attached Servant was Appraised at Eighteen hundred pounds of tobacco by John Mackbride and Robert Crouch Appraisers appointed. John : Mackbride : Robert C Crouch his marke.----- order Execution Issue. giving Security --- __________________________________________________________________ Somerset County Ss. The Jurors for their Maties being Sworne upon the holy Evangelists at a Grand Jury held for the Body of this County doe present and find that Elizabeth Puddiford Their Maties att the house of Henry Potter of this County hath most wickedly Sinfully & shamfully agt. Comitted fornication and borne a Basterd Child to the great dishonour of Almighty God Eliz.Puddiford Scandall and evill Example of the good People of this Province and in Contempt of the Laws, Their Maties Attorney Craves Judgment may be entered agt the said offender as in Law is provided James Sangster. Clk Indt. - - - - - - - - - The Prisoner at the Barr viz the said Elizabeth Puddiford Confesseth to the Indt read and Saith Roger: Hurley is the ffather of her Basterd Child. and for wch said Offence the Court did Order her thirty 20 lashes upon her bare back well laid on wch was performed. _______________________________________________________________________ Dennis Odeer Anthony Asher and John: Poore being Sumoned to answer unto Andrew Whittington concerning a boat stollen from the said Whittington Their Maties and for which fact the said Dennis and for his misdomeanours toward the Court agt. and his master was ordered thirty lashes which was by the Sheriffe at the Dennis Odeer Whipping post well laid on upon his bare back. - - - - - - - - - - - Anthony Asher being called who appears at the Barr being Sick and very penitent, and likewise his master craving the Courts favour to pardon his Offence which was granted. And the same likewise granted to John Poore. The masters of the above said Servants viz Randall Revell Miles Grey and Stephen Horsey by order of Court is to pay to the said Whittington in Consideration for the said Boat four fold viz each one third of the four fold vid fo 36 Nathaniel Horsey Obliges him Selfe to Court to make good what shall be Stollen by John:Poore dureing his Servitude, or to produce the sd Boat to abide judgment. - - - - - - - - - - - - - |
