Janry 13th. 1689/90 35 Then appeared in Court Sarah: Ward servant woman to John: King. being presented by the Grand Jury the Second tuesday in March for Basterd bearing, and being duely examined by the Court openly confessed the fact and sayeth that Joseph: Cotler is the ffather of her Basterd Childe. for which offense the said Sarah humbly beggs their Worships to remit corporall punishment and that a fine may be taken Which was granted by the Court, She giving Security for fourty dayes worke and dyet when demanded by ye Court as also for her good behaviour and Court charges and that she should appear next Court their to prosecute Joseph: Cotler. - - - - - And thereupon came John: King and by Recognizance did Oblige himselfe to the Court, for the said Sarah=s performances as above. - - - - - - - - - Somersett County. Ss. The Jurors for their Matie being sworne upon the holy Evangelists at a Grand Jury Held for the body of this County the second tuesday in November last past do present and find that Katherine Tully Woman Servant to Walter Lane of this County hath most wickedly Sinfully and shamefully committed fornication and at one birth borne two Bastard Children being the second Offense. to the great dishonour of Allmigty God, great scandall and evill Example of their Maties good people and against the lawes and Institutions of this Province Their Maties. Attorney Craves judgmt. may be entered, against the said Offender according to Law in that Case made and provided. - - - - James Sangster Clk Indt. The aforesaid Indictmt. being read before the Prisoner at ye Barr, who pleads not guilty to the Indt. but sath she is marryed to one Bryan Kelly a bout three months agoe and the said Bryan then appearing Owneth the same, as also to be the ffather of these two Children (which Children) was adjudged to be at least six months old, And for which said offence the Court Ordered them to pay thirty dayes work a peece and dyet, but want of Security, the Court then Ordered them thirty lashes a peece to be well laid on, on their bare backs, which by the Sub Sheriffe was executed. - - - - - - - - - - - - Somersett County Ss The Jurors for their Maties being sworne upon the holy Evangelists at a Grand / Jury held for the body of this County the second tuesday of November last past, do present and find That Daniel. McGlachan, and Jane Lee both of this County, upon the Eve before their Maties Proclaimed not having any feare of God before their eyes, but most wickedly shamfully and sinfully with each other did commit that abominable and heinous Sin of Adultery upon the Seventeenth of September last past to the great dishonour of Almighty God, abuse of their bodyes the scandall and evill example of the good people of this Province and against the Laws and Institutions thereof. Their Maties / Attorney Craves judgment against the said Daniel and Jane. according to Law &c. - - - - - - James Sangster Clk Ind. This foregoing Petion Indictmt. being read before the Prisoners at the Barr, both pleads not guilty of the Indt. Only MaGlachan confesses to be drunk for which he was ordered to be fined according to Act of Assembly. No Substantial Evidences / appeaing, the Court Orders both the said Daniel and Jane to give Security for good behaviour duering pleasure, and Court Charges. And thereupon came Capt John. Winder, and did acknowledge him selfe to be indebted unto thir Majties. in the penall sumof Ten pounds Sterling money to be leavyed on his goods and Chattels C The Condition of which Recognizance is such that if the said Daniel. be of good behaviour and abearance to all their Maties Leige people of this Province, then the sd acknowledgment or Recognizance to be voyd otherwayes to be and Remaine in full power force and vertue, and the said Daniel was likewise bound in twenty pounds as above. Same time came Thomas: Lee and William Currey and Obliges them selfes as above for Jane Lee=s good behaviour and Court Charges. . - - - - - - - - - - - - - - - - - - - - Ordered that Margeret Carmaday by Evidence made to the Court by John: Kellam be free from her servitude. } mr.
